HomeMy WebLinkAboutOrdinance No. 99-O170 ORDINANCE NO. 9 9-017 AN ORDINANCE OF THE CITY OF AZUSA, CALIFORNIA, AMENDING SECTIONS 10-56, 10-57, 10-58, 10-59, 10-60 10- 61, 10-62 AND 10-63 OF CHAPTER 10 OF THE AZUSA MUNICIPAL CODE CONCERNING ANIMAL LICENSING WHEREAS, the City of Azusa is a member of the San Gabriel Valley Animal Joint Powers Authority (JPA); and WHEREAS, the JPA has contracted with the San Gabriel Valley Humane Society (the "Society") to provide animal control services; and WHEREAS, each JPA city has administered its own dog licensing enforcement program, including the City of Azusa which has contracted independently with the Society to provide dog licensing for Azusa; and WHEREAS, the JPA has determined that a unified dog licensing program would result in more dogs being properly vaccinated for rabies, reduce excess pet populations, provide an easier system for City residents to license their dogs, generate greater revenue and be fully cost -recoverable; and WHEREAS, the City wishes to participate in and implement the JPA's uniformed dog licensing program. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 10-56 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: "Sec. 10-56. Dog License Required. (a) Any person who owns or has custody of a dog over the age of four months, and who resides in the City of Azusa, shall obtain a license for the privilege of keeping the animal. Any dog over the age of four months which is sold or given away within the City shall be licensed by the new owner or custodian within fifteen (15) days of the sale or acquisition. (b) Exceptions to this section include: (1) Dogs kept within the City by an owner or custodian for no more than 30 days. RVPUB\NGS\519890 (2) Dogs used to aid humans with their disabilities when the dog is certified by a recognized aid dog institution shall be issued a license at no cost. (3) Dogs used by the City's Police Department shall be issued a license at no cost. (4) Dogs owned by senior citizens on low income, as established by the San Gabriel Valley Animal JPA, shall be issued a license at no cost, one per house address. (5) Dogs which have served in the armed forces of the United States. and have received an honorable discharge shall be issued a license at no cost. (c) All dogs receiving licenses at no cost shall be vaccinated or revaccinated with rabies vaccine as provided for in division 4 of this article." SECTION 2. Section 10-57 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: "Sec. 10-57. Dog License Application; Procedures. (a) An application for a dog license shall include: (1) The name, residence address and telephone number of the dog's owner or custodian. (2) The breed, color, special markings, age, sex and reproductive status of the animal. (3) The microchip identification or tattoo number with the name, address and telephone number of the microchip or tattoo registry. (4) The license fee required by regulation. (5) A copy of the dog's current rabies vaccination certificate. (b) A dog license which expires on June 30, of the year of issuance, except for new licenses issued between April I and June 30, shall be good from the date of issuance until June 30 of the following year. A three-year license expires on June 30 of the third year of the license. RVPUQ\NGS\5I9B90 (c) Applications to renew licenses shall be made between April 1 and June 30 of each year and shall be made in the same manner as an application for a new license. (d) The San Gabriel Valley Animal JPA may permit the application, purchase and issuance of dog licenses by mail." SECTION 3. Section 10-58 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: "Sec. 10-58. Authorized Vendors of Dog Licenses. The San Gabriel Valley Animal IPA may authorize other persons as vendors to issue dog licenses. Vendors may use a computer generated application, approved by the San Gabriel Valley Animal JPA, if the form contains the same information set forth in Section 10-57 of this chapter." SECTION 4. Section 10-59 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: "Sec. 10-59. Dog License Tags and Receipts. (a) A dog shall bear a license tag securely fastened to its collar, chain collar, or harness at all times. Exceptions are for dogs confined on the owner's or custodian's premises or while in competition. (b) A numbered receipt and a tag stamped with a number, authorized by the San Gabriel Valley Animal JPA, shall be issued for each license purchased. (c) No person may use a dog license tag, microchip, or receipt for an animal other than the one for which it was issued. (d) No person shall be issued a dog license if the applicant's keeping of the dog: 1) constitutes a health hazard to humans or other animals; or 2) violates any ordinance or regulation under this Municipal Code. (e) In the event that a dog license tag is lost, stolen, or destroyed, a person may apply for a duplicate dog license tag upon payment of $.50 and filing a certificate stating the tag was lost, stolen or destroyed." SECTION 5. Section 10-60 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: RVPUMNGS\519890 "Sec. 10-60. Penalty Assessment. A fifty percent (50%) penalty assessment will be levied for each dog not licensed on or before August 1 of each year in the case of single year licenses, and in the case of three-year licenses, on or before August 1 of the third year of the license." SECTION 6. Section 10-61 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: "Sec. 10-61. Voluntary Cat License. Any person who resides in Azusa may purchase a voluntary cat license, for the purpose of cat identification. The license may be issued for three years or lifetime period (with microchip). The three-year license will include a cat license receipt and a stamped numbered identification tag. The lifetime license will include a cat license receipt, stamped numbered identification tag, and microchip transponder." SECTION 7.. Section 10-62 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows: "Sec. 10-62. Fees. The City Council may, by resolution, from time to time, change the rate of fees to be charged for the services provided through the licensing program." SECTION 8. Section 10-63 of the Azusa Municipal Code is hereby deleted in its entirety and restated to read as follows. "Sec. 10-63. Recognition of licenses from other jurisdictions. (a) When a dog has been validly licensed in another jurisdiction and has been brought into the City for permanent residence, the license and tag may be replaced -with a city license and tag for the balance of the license year upon payment of a transfer fee of $.50 and the surrender of the former license tag. If the dog has been vaccinated with rabies vaccine in another jurisdiction within the time limits prescribed in division 4 of this article, the license issued shall show the type of vaccine used and the date of vaccination. Otherwise, the dog shall be vaccinated as provided for in division 4 of this article. (b) No transfer fee will be required for any dog brought into the City for permanent residence which has been validly licensed through the San Gabriel Valley Animal JPA in another city. @VPUB\NGS\519890 SECTION 9. This Ordinance shall be in full force and effect thirty (30) days after its passage. SECTION 10. A summary of this Ordinance shall be published in the manner required by law.
