HomeMy WebLinkAboutOrdinance No. 01-O5ORDINANCE NO. 0 -05 AN ORDINANCE OF THE CITY OF AZUSA, CALIFORNIA ESTABLISHING A HUMAN RELATIONS COMMISSION BY AMENDING CHAPTER 2, ARTICLE V AND ADDING DIVISION 6 TO THE AZUSA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 2, Article V of the Azusa Municipal Code is hereby amended to add Division 6 to read as follows: "Division 6 HUMAN RELATIONS COMMISSION Sections: 2-420 Purpose 2-421 Appointment and terms 2-422 Powers and duties 2-423 Compensation 2_424 Residency and eligibility Sec. 2-420 Purpose. The Human Relations Commission is established to create a community that demonstrates inclusion, diversity and civic peace by developing and monitoring a comprehensive plan that eliminates hate and inter -group conflicts and ensures that rights guaranteed by California State law and the United States Constitution are protected for all citizens, regardless of race, color, gender, religion, national origin, ancestry, age, sexual orientation, disability, socio- economic or immigration status or any other personal characteristic. Sec. 2-421 Appointment and terms. The Commission shall consist of nine members with each member appointed for a [three-year or other] term. Six of the members shall be appointed by a majority vote of the city council pursuant to section 2-32 of this Code. Two of the members shall be recommended by the governing board of the Azusa Unified School District and shall be appointed by a majority vote of the city council. One member shall be "a commission appointee" selected by a majority vote of the appointed eight members approved by the city council. With the exception of the commission appointee, commission members may be removed from the commission pursuant to section 2-32 of this Code. 0 0 Sec. 2-422 Powers and Duties. The Commission shall serve in an advisory role to the city council and the city manager to address inter -group and inter -cultural relations, the causes and response to hate and for the development of policies, practices and implementation of programs. Subject to final approval by a majority vote of the city council, the commission may appoint committees from time to time to assist the Commission in fulfilling its purpose to promote diversity, inclusion and the eradication of hate. See. 423 Compensation. Each member of the commission shall receive compensation in an amount to be established by resolution of the city council. Each member may also be reimbursed for any reasonable and necessary expenses incurred in the performance of commission duties. Sec. 424 Residency and eligibility. Non-residents of City of Azusa may be appointed to the commission. To be eligible for appointment to the commission, a person must demonstrate that he or she is committed to the general well-being and welfare of the community. Non-residents must further demonstrate that they have actively participated in the City's community activities for at least one year prior to the anticipated date of appointment. Non-residents appointed to the commission shall continue to actively participate in community activities while serving on the commission. SECTION 2. Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason deemed or held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portion of this ordinance. The City Council hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsection, sentences, clauses, phrases or other portions might subsequently be declared invalid or unconstitutional. SECTION 3. This ordinance shall be in full force and effect thirty (30) days after its passage. l SECTION 4.
