AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF AZUSA
AMENDING ARTICLE XIII, SECTION 88-1885(x)
OF THE MUNICIPAL CODE PERTAINING TO TIME EXTENSIONS
FOR NONCONFORMING USES
WHEREAS, the Municipal Code provisions for the granting of time extensions for
nonconforming uses, as set forth in Section 88-1885 need clarification, and
WHEREAS, there is a need for the zoning administrator to have greater latitude in being
able to grant time extensions for nonconforming uses, and
WHEREAS, the Planning Commission has conducted a duly noticed public hearing on
March 27, 2002, to consider a code amendment addressing the aforementioned matters, and
WHEREAS, the Planning Commission has recommended approval of the code amendment
to the City Council with a minor amendment,
NOW THEREFORE, the City Council of the City of Azusa does hereby ordain as follows:
SECTION 1: Article XIII, Section 88-1885(a) is hereby amended to read as follows:
"ARTICLE XIII. NONCONFORMING USES, BUILDINGS AND STRUCTURES
Section 88-1885. Nonconforming use - Abatement
(a) Genera/. All legal nonconforming uses shall cease operations 20years from the
date upon which such uses became nonconforming. However, the zoning administrator
shall have the authority to grant time extensions up to, but in no event more than, ten
years, provided that findings can be made that such extensions will not be detrimental to
public health, safety, welfare, or future planning and development of the area."

SECTION 2: This Ordinance shall be posted in accordance with provisions of the Azusa
Municipal Code and shall become effective thirty (30) days from and after the date of its passage.
SECTION 3: The City Clerk shall certify the adoption of this ordinance and shall cause
the same to be published as required by law.

Ordinance N002-06 was regularly introduced and placed upon its first reading at a regular
meeting of the City Council on the 15'h day of April, 2002. That thereafter, said Ordinance
was duly adopted and passed at a regular meeting of the City Council on the6th day of May ,
2002, by the following vote, to wit:
