HomeMy WebLinkAboutResolution No. 48660 0 RESOLUTION NO. 4866 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A CONDITIONAL USE PERMIT - VARIANCE. (V-121 Perz) The City Council of the City of Azusa does resolve as follows: SECTION 1. It is hereby found and determined that appli- cation for a variance to permit the erection or relocation and mainte- nance of more than one dwelling unit upon a lot located in the R -lc Zone described as the East 91 feet of Lots 35 and 36 of Tract 13824 located at 651 West Gladstone, Avenue, Azusa, was duly made, that a hearing thereon was duly held by the Planning Commission after legal notice thereof, that the Planning Commission denied said variance by its Resolution No. 518, that said action was appealed to the City Council and that the City Council has held a hearing thereon after legal notice thereof. SECTION 2. It is hereby found by the City Council that facts exist justifying the granting of said variance subject to the conditions hereinafter set forth. SECTION 3. A variance is hereby granted to permit the erection or relocation and maintenance of more than one dwelling unit upon said East 91 feet of Lots 35 and 36 of Tract 13824, provided, however, that a total of not more than three dwelling units shall be permitted on said premises whether attached or single units, including any dwelling unit now on said premises, and subject to the following conditions: 1. That the applicant shall submit two copies of a precise plan of design incorporating any of the following conditions that can be shown on the plan, and indicating parking spaces, buildings, the location of the buildings and such other information pertinent to the development of the proposed use. Such plan shall be subject to approval by the Planning Commission. The applicant or owner shall develop subject property substantially as shown on said approved plan. 2. It is further declared and made a condition of this variance, that if any condition hereof is violated, or if any other law or statute, or ordinance is violated, the variance shall be sus- pended and the privileges granted hereunder shall lapse, provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty days. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall transmit a certified copy thereof to applicant. Adopted and approved this 21st day of June , 1965.
