A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA GRANTING A CONDITIONAL USE PERMIT - VARIANCE.

The City Council of the City of Azusa does resolve as
follows:
SECTION 1. It is hereby found and determined that appli-
cation for a variance to permit a transmission repair and auto
dismantling business in Zone M-1 upon property described in Planning
Commission Resolution No. 509 and located at 1020 West Foothill
Boulevard, Azusa and being a portion of Lot 43, Azusa Land and Water
Company was duly made, that a hearing thereon was duly held by the
Planning Commission after legal notice thereof, that the Planning
Commission denied said variance by its Resolution No. 509, that
said action was appealed to the City Council and that the City Council
has held a hearing thereon after legal notice thereof.
SECTION 2. It is hereby found by the City Council that facts
exist justifying the granting of said variance subject to the conditions
hereinafter set forth.
SECTION 3. A variance is hereby granted to permit the
establishment use and operation of a transmission repair and auto
dismantling business in Zone M-1 on said parcel of property known as
and located at 1020 West Foothill Boulevard, Azusa, subject to the
following conditions:
1. That the applicant shall submit two copies of a plot
plan incorporating any of the following conditions that can be shown
on the plan, and indicating parking spaces, buildings, the use of
the buildings and such other information pertinent to the development
of the proposed use. Such plan shall be subject to approval by the
Director of Planning. The applicant shall develop subject property
substantially as shown on said approved plot plan.
2. That the yard shall be completely enclosed by the
building „ block wall, and gate.
a. Except for block building and gateway in front
of property, the yard shall be enclosed by a concrete
block wall of an uniform height of a minimum of 6 feet.
b. Yard shall be completely enclosed prior to
operations.
c. Gate shall be of solid material (preferably
redwood) located in driveway opening, eight (8) feet
in height, thus making a solid front across subject
property.
3. That the yard utilized for storage of cars shall be
maintained in a neat and orderly condition.
4. That there shall be no stacking of automobiles and
stacking of parts shall be limited to the height of the fence, and
no stacking shall occur over the fence height.
5. That no dismantling shall be done outside of enclosure,
nor shall there be any unloading and/or storage of material in front
of building along Foothill Boulevard.

6. No signs shall be permitted other than where listed
on the approved precise plan (plot plan).
7. That there shall be a semi-annual inspection by the
Planning Department and/or zoning Enforcement Official.
8. That there shall be no smashing, baling, or burning
of materials.
9. That a minimum of six (6) parking spaces shall be shown
on the plot plan.
10. That the hours of operation shall be limited to
between 6 A.M. and 6 P.M., Monday thru Saturday.
11. That this exception shall not become effective for
any purpose until the owner and/or prospective applicant of the property
involved have filed at the office of the Planning Department their
affidavits stating that they are aware of, and accept all the conditions
of this Variance.
12. It is hereby declared to be the intent that if any
provision of this exception is held or declared to be invalid, the
Variance shall be void and the privileges granted hereunder shall
lapse.
13. It is further declared and made a condition of this
Variance, that if any condition hereof is violated, or if any other
law or statute, or ordinance is violated, the Variance shall be
suspended and the privileges granted hereunder shall lapse, provided
that the applicant has been given written notice to cease such
violation and has failed to do so for a period of thirty (30) days.
SECTION 4. The City Clerk shall certify to the adoption of
this resolution and shall transmit a certified copy thereof to
applicant.
