HomeMy WebLinkAboutResolution No. 5116RESOLUTION NO. 5116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA OBJECTING TO CURRENT APPLICATION OF THE FIST ACT AND RECOMMENDING THAT THE STATE REVIEW THE ACT AND ITS APPLICATION IN LIGHT OF CURRENT CONDITIONS. WHEREAS, a recent ruling of the Attorney General that School Board members are individually financially responsible for liability resulting from earthquake damage is creating a condition that is exerting undue pressure upon said school board members; and WHEREAS, this pressure is causing actions that have the potentiality to bankrupt many of the school districts in the State; and WHEREAS, the taxpayers are becoming increasingly reluctant to approve bond issues for new construction due to growth in the community because they observe on the other hand wanton destruction of older buildings under the Field Act, which often appear to have been more sturdily built than the new construction; and WHEREAS, present interpretation of the Field Act is probably more far reaching than the act intended when drafted in 1933; and WHEREAS, present structures have withstood earthquakes of near magnitude and intensity to the Long Beach earthquake; which brought about the passage of the Field Act; and WHEREAS, there is no guarantee that an earthquake of sufficient magnitude and intensity to topple the present buildings would not also level the new structures. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa that the officials of the City of Azusa, while favoring safety for the children of this community nevertheless feel that the situation has progressed from the sublime to the ridiculous with observed incidents of wreckers having extreme difficulty destroying buildings declared unsafe by the engineers conducting Field Act inspections and they entreat the Governor and the Legislature to take steps to modify or amend this act and related legislation including that imposing individual liability on school board members before further waste is accomplished. Approved and Adopted this 3rd day of October, 1966. I hereby certify that the foregoing Resolution was duly adopted by the City Council of the City of Azusa at a regular meeting thereof held on the 3rd day of October, 1966, by the following vote of the Council: AYES: Councilmen: Rubio, Cooney, Solem, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: McLees -2-
