HomeMy WebLinkAboutResolution No. 5061E RESOLUTION NO. 5061 E A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE. (V-155 - J.W.Carr) The City Council of the City of Azusa does resolve as follows: SECTION 1. It is hereby found and determined that appli- cation for a variance to permit a residential use without additional off-street parking upon lots located in the C-3 Zone described as Lots 6 and 7, Block 36, Map of Azusa, located at 134-136 E. Foothill Boulevard, Azusa, was duly made, that a hearing thereon was duly held by the Planning Commission after legal notice thereof, that the Plan- ning Commission denied said variance by its Resolution No. 598, that said action was appealed to the City Council and that the City Council has held a hearing thereon after legal notice thereof. SECTION 2. It is hereby found by the City Council that facts exist justifying the granting of said variance subject to the conditions hereinafter set forth. SECTION 3. A variance is hereby granted to permit a resi- dential use in the C-3 Zone, and to reduce the parking requirements upon said property subject to the following conditions, violation of any of which shall be grounds for terminating this variance: 1. Said residential use shall consist of the use of existing apartments upon said premises, but shall not be commenced until all of the following conditions have been fulfilled. 2. All corrections, improvements and repairs set forth in the letter attached hereto and marked Exhibit A, shall be completed to the satisfaction of the Building Inspector. 3. All of the conditions set forth in the letter attached hereto and marked Exhibit B. shall be corrected or repaired to the satisfaction of the Building Inspector. 4. The existing parking area shall be improved with asphalt surfacing and lined or striped to accommodate the largest possible number of parking spaces. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall transmit a certified copy thereof to applicant. Adopted and approved this 20th day of June 1966. Carr - o Property 134-136 East Foothill, Azusa o Dear Mr, Miller: co As requested by the City Council, an inspection of subject properties was made by the Building Inspector and a member of the Fire Department on May 24, 1966, As a result of this inspection it was found that the market and liquor store at 138 East Foothill Boulevard, beneath the proposed apartment house, had non- conforming wiring. The music store at 134 East Foothill Boulevard also had non -conforming wiring. It is felt that the wiring, in this condition, would not provide reasonable life and fire safety to any residents living above this area. The proposed apartment house at 136 East Foothill Boulevard does not meet certain provisions of the Building Code, State Housing Laws, California Adminis- trative Code Titles 19 and 24: 1. Heater flues are too close to combustibles. Some heaters are without flues. Z. Plumbing deficiencies in regards to the cross connects in the toilet tanks. 3. The general area needs clean up and painting. 4. Dampness of habital rooms - T24 713.212k. Apparently rain water has penetrated to the insides of the rooms. 5. T24 Sec. 713. 20d. The roof shall be kept waterproof. Some of the rooms showed results of a leaking roof. 6. T24 Sec. 713, 21 8a. Faulty weather protection. Deteriorated, crumbling and loose plaster was observed in some of the rooms. 7. No fire extinguishers were present. Type of exit doors and apartment doors to the corridor are non -conforming. This inspection and review shall not be construed as encompassing the structural stability of the building, or as abrogating any more requirements by other agencies, including our own. Marlowe R. CALIF. 91107 Mar. 23, 1966. Regarding the building located at 136 East Foothill Blvd., Azusa, Calif. The following are the main conditions to be corrected: Front of building to be re -decorated. The rear door of the Market to have a steel door the same as the door at the rear of the music store. The staircases, both front and rear to be thoroughly cleaned down and painted, with good quality paint. The entire upstairs to be re -decorated as follows: All floors to be sanded by machine, the wood filled and all floors, rooms and hallway, to be varnished with two coats of best quality varnish. All plumbing to be inspected and re- paired to purchasers acceptability All walls, both in the apartment rooms and hallway to be cleaned and re- decorated. All stoves and heaters to be thoroughly inspected and repaired. Roof of building to be repaired - not patched bya competent.roofing concern. All leaks completely seal- ed.
