HomeMy WebLinkAboutResolution No. 5050RESOLUTION NO. 5050 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF-.AZUSA ACCEPTING A CERTAIN GRANT OF EASEMENT AND DIRECTING THE RECORDING THEREOF. The City Council of the City of Azusa does resolve as follows: The City of Los Angeles, a SECTION 1 That certain Grant of Easement executed by municipal corporation and the Department of Water and Power of the City of Los Angeles, under date of 19th day of April 1966, granting to the CITY OF AZUSA, a Municipal Corporation in Los Angeles County, California, its successors and assigns, the right to perpetual easement and right of way for public purposes for sewer purposes in,- on, over, under, across an -a ong, the following described- reaproperty situate in the Cl Y. . OF AZUSA, Los Angeles County, State of California to wit: Said Grant of Easement is hereby accepted, and the City Clerk is hereby authorized and directed to cause the same to be filed for record in the office of the County Records of said County. SECTION 2 The City Clerk shall certify to the adoption of this Resolution. Adopted and approved this 6th day of June 19 466 Mayor of the City of Azusa I hereby certify that the foregoing Resolution was duly adopted by the City Council of the City of Azusa at a regular meeting thereof, held on the 6th day of June, 19 66, by the following vote of the Council: AYES: Councilmen: Rubio, Cooney, Solem, McLees, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None 1 ud Qr i Clerk of the City of Azusa 0 0 All that part of a portion of SW 1/4 of the NW 1/4 of the SW 1/4 of Fractional Section 2, Township 1 South, Range 10 West, S.B.B.&M. described in deed recorded in Book D-2535, Page 564 of Official Records of Los Angeles County, lying within a strip of land 12 feet in width, the side- lines of said strip of land being parallel with and distant 6 feet on each side of a centerline described as follows: Beginning at a point on the centerline of Newburgh Street, 54 feet in width, as shown on Record of Survey recorded in Book 76, Page 44 of Record of Surveys of said County, distant thereon S. 89054153" E., 349.94 feet, from its intersection with the centerline of Azusa Avenue, 100 feet in width, as shown on said Record of Surveys; thence from said point of beginning N. 12°37119" E., to a point on the northerly side- line of the said portion of Fractional Section 2 described in deed recorded in Book D-2535', Page 564 of Official Records. SUBJECT TO any and all existing uses and encroachments and to all matters of record, and all upon and subject to the following terms, covenants and conditions, to which the Grantee by acceptance of deed shall expressly agree, to wit: 1. The exercise of the easement rights herein granted shall not in any wise endanger, interfere or obstruct the improvements now or here- after constructed thereon by Grantor, except as hereinafter provided. 2. Grantee,' insofar as it may legally do so, shall indemnify and hold harmless the Grantor, its officers, agents and/or employees, from any and all liability, loss or damage which said Grantor, its officers, agents and/or employees may suffer by reason of the exercise of any of the rights granted to it under this instrument, except.as hereinafter provided. 3. All work done, pursuant to the terms of this agreement,_ shall be done in accordance with the terms and conditions specified in ordin- ances and statutes governing such instances; and, the provisions of such ordinances and statutes are, by reference, made a part hereof as though incorporated verbatim herein. 4. Because of overhead electrical conductors, only such equip- ment shall be used as is consistent with the terms of safety ordinances and statutes in such cases made and provided; and, the provisions of such safety ordinances are, by reference, made a part hereof as though incorporated verbatim herein. Grantee does not by this easement take any right or rights other than those herein expressly granted, as limited herein, and with the exceptions and reservations set forth.
