RESOLUTION N0, 5007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA FINDING THAT THE PUBLIC INTEREST, CONVENIENCE
AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN
PROPERTY FOR STREET PURPOSES - CERRITOS AVENUE.
The City Council of the City of Azusa does resolve
as follows:
SECTION 1. That the City Council hereby finds, determines
and declares that the public interest and necessity require the
acquisition of right of way in, on, over and under the hereinafter
described real property for public street purposes and all uses
appurtenant thereto.
That the location of the land for said street has been
planned and located in the manner which will be most compatible
to the greatest public good and the least private injury.
SECTION 2. That the City Council finds, determines and
declares that, in order to acquire said right of way in, on, over
and under said land for said Street purposes, and use the same for
said purposes, the public interest, convenience and necessity re-
quire the acquisition of the right of way by the City of Azusa In,
on, over and under that certain real property hereinafter described
and the City Council hereby declares it is the intention of the
City of Azusa to acquire in its name said right of way in, on, over
and under said hereinafter described real property by condemnation
in accordance with the provisions of the Code of Civil Procedure
and the Constitution of the State of California authorizing the
exercise of the right of eminent domain.
SECTION 3. That said real property, the acquisition of which
Is required by the public interest, convenience and necessity for
the purpose set forth in Sections 1 and 2 hereof, is described as
follows:
That portion of Lots 83 and 84 of Subdivision No, 2, Azusa
Land and Water Co., in the County of Los Angeles, State of
California as recorded in Miscellaneous Records, Book 43,
page 94 in the office of the County Recorder of said County
and more particularly described as follows:
Commencing at the southeast corner of Lot 3, Tract 14540
as recorded in Map Book 300, pages 19 and 20 in the office
of the County Recorder of said County; thence east along
the northerly line of Tenth Street (60 feet wide, as it
existed on March 23, 1966) a distance of 178.94 feet to
the true point of beginning, said point also being the
beginning of a tangent curve concave to northwest having
a radius of 25.00 feet; thence northeast along said curve
oof 39,2 aPeet; thenncelNe 0° 02' 32" W2839-59 feet; thencece
S 320 36, 27" E 89.01 feet; thence S 32° 27' 22" E 61.96
feet; thence 3 9° 43' 001' W 80.45 feet; thence S 290 47'
00" E 25.22 feet; thence S 00 02' 32" E 636.16 feet; thence
west 105.02 feet to the true point of beginning.

SECTION 4. That the City Attorney of the City of Azusa and
Burke, Williams & Sorensen hereby are authorized, empowered and
directed to prepare, institute and prosecute in the name of the
City of Azusa such proceedings in the proper court having juris-
diction thereof as are necessary for the condemnation of said rights
of way in said real property described in Section 3 of this
Resolution.
Said attorneys hereby are authorized and empowered to take
such procedure as may be necessary to secure an order of immediate
possession for the use of and occupancy of said property.
SECTION 5. The City Clerk shall certify to the adoption of
this Resolution.
