HomeMy WebLinkAboutResolution No. 5301RESOLUTION NO. 5301 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ORDERING THE VACATION OF A CERTAIN PORTION OF AZUSA AVENUE SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN RIGHTS AND EASEMENTS. The City Council of the City of Azusa does resolve as follows: SECTION 1. WHEREAS, proceedings were instituted by the City Council to vacate a certain portion of Azusa Avenue under the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California, and a resolution of its intention to vacate said portion of said street was adopted and approved on the 21st day of August, 1967, and a hearing fixed for the 18th day of September, 19670 and notice was given in accordance with Section 9322 of the Streets and Highways Code of the State of California, and after hearing had as scheduled and there were no valid portests or reasons given as to why said portion of said street should not be vacated, and the City Council does hereby determine that said portion of said street is unnecessary for present or prospective public street purposes; therefore, that the certain portion of Azusa Avenue hereinafter described be and the same is hereby vacated, subject to the reservation of the rights, easements and rights of way hereinafter set forth to wit: That portion of the Azusa Rancho belonging to Henry Dalton in the City of Azusa, County of Los Angeles, State of Cali- fornia, as recorded in Book 2, pages 106 and 107 of Patents, Records of Los Angeles County, California, Commenci at the intersection of Sierra Madre Ave. (50 feet wide and Azusa Ave. (80 feet wide) as shown on the Map of Tract 627 as recorded in Map Book 15, pages 106 and 107 in the office of the County Recorder of said County; thence S 00° 20' 51" W along the centerline of Azusa Ave. 46.36 feet to the true point of beginning; thence S 00° 20' 51" W along said centerline 208.22 feet; thence N 89° 39' 09" w 40.00 feet to the intersection of the westerly line of Azusa Ave. and the easterly line of San Gabriel Canyon Road; thence N 000 20' 51" E along said westerly line, 206.53 feet to a point on a curve concave to the northwest having a radius of 3800 feet, a radial to said point bears N 10 46' 00" W; thence northeasterly along said curve through a central angle of 00 36' 13' for an arc distance of 40.03 feet to the true point of beginning, a radial to said point bears N 20 22.' 13" W. SUBJECT TO AND RESERVING AND EXCEPTING from said vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, renew and enlarge therein lines of pipe, conduits, cables, wires and poles, and other convenient structures, equipment and fixtures for the operation and distribution of storm drain, sewer, water and gas pipe lines, and traffic signal conduits, and electric energy, telegraph and telephone poles and wires and cables. 0 SECTION 2. The City Clerk of this resolution and shall cause a by said City Clerk under the seal of office of the County Recorder of Los LJ shall certify to the adoption certified copy thereof attested the City to be recorded in the Angeles County.
