RESOLUTION NO. 5297
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA GRANTING A CONDITIONAL USE PERMIT. (C-72 -
Harold Fry)
The City Council of the City of Azusa does resolve as follows:
SECTION 1. It is hereby found and determined that application
for a Conditional Use Permit allowing an automobile service station in a
C-2 Zone on the following described property, to wit: Lots 16, 17, 18 and
19 in Block 76 of Azusa, as per map recorded in Book 15, page 93, et seq.
of Miscellaneous Records in the office of the County Recorder of said
County, EXCEPT that portion designated as Parcel No. 5 in condemnation
action case No. 697076, Superior Court Los Angeles County, a certified
copy of final decree recorded February 41 1959, in Book D-355, page 450,
Official Records in the office of the County Recorder, located at 101
North Azusa Avenue, was duly made, that a hearing thereon was duly held
by the Planning Commission after legal notice thereof, that the Planning
Commission denied said application by its Resolution No. 675, that said
action was appealed to the City Council and that the City Council has held
a hearing thereon after legal notice thereof.
SECTION 2. It is hereby found by the City Council that facts
exist justifying the granting of said conditional use permit subject to
the conditions hereinafter set forth, violation of any of which shall
be grounds for the termination of this permit.
SECTION 3. A conditional use permit is hereby granted to
allow the establishment and maintenance of an automobile service station
located on the property above described at 101 North Azusa Avenue, subject
to the following conditions, violation of any of which shall be grounds
for termination of this permit.
1. All utilities, including electric and telephone, shall
be placed underground.
2. Off-street parking shall be provided for 5 automobiles,
properly striped and with bumper guards.
3. All lighting shall be so arranged and shielded so there
will be no glare or reflection onto adjacent residential properties or
public rights-of-way.
4. Total sign area shall not exceed 100 square feet in area,
therefore, the 4' x 31' sign shown on the proposed plans will have to be
reduced in size.
5. An additional planter shall be provided in the area between
the two driveways on the First Street side. All planted areas shall be
provided with a method of irrigation and permanently maintained.
6. The wall along the northerly property line shall remain in
its present location.
7. Construction shall be completed and the service station
shall be open for business within one year from the issuance of the building
permit.
8. That a concrete or masonry wall, without openings, be
constructed along the westerly property line of the service station site
abutting the alley. Said wall to be 6 feet in height, except for the
first 25 feet nearest First Street which is to be 42 inches in height.
9. Before construction begins under this permit, all asphalt,
rubbish and walls on the easterly portion of the residential lots previously
used for parking shall be removed provided the respective property owners
give permission to have this work done within 45 days after request for
such permission. Also, a 6 foot chain link fence shall be installed along
the rear property line of each of these residential lots, provided the
respective property owners agree within 45 days after request for such
permission.
10. Reconstruct the alley intersection on the North side of
First Street and westerly of Azusa Avenue to the satisfaction of the
Engineering Department.
11. The Variance approved by Resolution No. 3313 which allowed
the parking of cars on the east 54 feet of Lots 58, 59, 60 and 61 of Tract
14069 shall be considered void and terminated.
12. That all trash containers be concealed from view from
adjoining streets and properties.
13. That the construction comply with the plot plan submitted
to the City Council and marked Exhibit A.
SECTION 4. The City Clerk shall certify to the adoption of
this resolution and shall transmit a certified copy thereof to applicant.
