RESOLUTION NO. 5254
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA GRANTING A CONDITIONAL USE PERMIT. (C-71 -
Violet Ott)
The City Council of the City of Azusa does resolve as follows:
SECTION 1. It is hereby found and determined that appli-
cation for a Conditional Use Permit allowing an automobile service
station in a C-2 Zone on the following described property, to wit: That
portion of the NW 1/4 of the SW 1/4 of Section 2, T.I.S. R. 1OW2
S.B.M. in the City of Azusa, County of Los Angeles, described as follows:
Beginning at a point in the easterly line of Azusa Ave., 142 feet wide,
Distant S 0° O1' 48" W 170 feet from the westerly prolongation of the
southerly line of Gladstone Street, 50 feet wide; thence N 00 O1' 48" E
along said easterly line 153.00 feet; thence N 450 13' 24" E 23.96 feet
to said southerly line of Gladstone Street; thence S 890 35' 01" E along
said easterly line of Azusa Ave. 170.00 feet; thence N 850 35' 01" W
parallel with said southerly line of Gladstone Street, 144.04 feet to
the point of beginning,located at the southeast corner of Gladstone and
Azusa Avenue, was duly made, that a hearing thereon was duly held by the
Planning Commission after legal notice thereof, that the Planning Com-
mission granted said application by its Resolution No. 6712 that said
action was appealed to the City Council and that the City Council has
held a hearing thereon after legal notice thereof.
SECTION 2. It is hereby found by the City Council that
facts exist justifying the granting of said conditional use permit
subject to the conditions hereinafter set forth, violation of any of
which shall be grounds for the termination of this permit.
SECTION 3. A conditional use permit is hereby granted to
allow the establishment and maintenance of an automobile service station
located on the property above described at the southeast corner of Azusa
Avenue and Gladstone Street, subject to the following conditions, vio-
lation of any of which shall be grounds for termination of said permit:
1. That the architectural treatment of the proposed building
be in close conformance with "Exhibit All.
2. All conditions previously required and now shown on the
plot plan labeled "Exhibit B" shall be complied with.
3. No signs or vehicles shall be allowed in the corner
cut-off area.
4. All conditions of the Fire and Engineering Department's
reports must be complied with.
5. The signs as shown on "Exhibit B" are not in conformance
with the Zoning Ordinance and must be resolved at a later date.
6. There shall be a 5 foot wall built within one year, the
location of which shall be along the easterly property line or along the
westerly line of the easement as shown on the plot plan. Said wall
should be 102 feet long and connect with the wall on the southerly boundary.
7. All conditions embodied in the approval of this Con-
ditional Use Permit and in the plot plan shall be given to any future
lessee, the owners of the property, and the oil company.
8. The Precise Plan is to be submitted to the Planning
Director for final approval prior to the issuance of any building permits.

9. That a sanitary sewer serving the premises be provided
and be connected with the existing sanitary sewer at Newburgh Street
before a certificate of occupancy is issued.
10. That electric service to the premises be placed under-
ground.
11. The permit hereby allowed is conditional upon the
privileges being utilized within six months after the effective date
thereof, and if they are not utilized or construction work is not begun
within said time and carried on diligently in accordance with conditions
imposed by the Commission, this authorization shall become void, and any
privilege, permit or variance granted hereby shall be deemed to have
elapsed.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution and shall transmit a certified copy thereof to appli-
cant.
