RESOLUTION NO. 5499
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA SETTING FORTH CERTAIN APPROVED REGU-
LATIONS FOR THE OPERATION OF ESTABLISHMENTS
HOLDING PERMITS FOR CAFE ENTERTAINMENT.
WHEREAS, the City Council of the City of Azusa has
heretofore adopted Ordinance No. 942 adding Part 9 of Chapter
2 of Article IV of the Azusa Municipal Code relating to the
issuance of permits for establishments offering cafe entertain-
ment; and
WHEREAS, said Part 9 authorizes issuance of such
permits subject to such terms, conditions and restrictions
regulating operation and conduct of establishments holding such
permits as approved by this Council; and
WHEREAS, after due consideration and having found
that the regulations set forth below governing the operation
and conduct of establishments holding permits for cafe enter-
tainment are necessary and expedient to protect the public
peace, health, safety, morals and welfare of said City and its
inhabitants;
BE IT RESOLVED, that each and every entertainment
permit issued pursuant to said Part 9 shall be subject to the
following terms, conditions and restrictions:
(a) There shall be no entertainment of any kind
which is visible from the street.
(b) No entertainment or music of any sort shall be
permitted between the hours of 2:00 A.M. and 10:00 A.M.
(c) Gambling in any form shall not be permitted or
engaged in on the premises. No machine or machines designed
or commonly used for the purpose of gambling in any form, or
readily adaptable to such use, may be kept on the premises.
(d) No entertainer shall mingle or associate with
any patron except when conventionally dressed in street clothes.
(e) No entertainment shall be conducted at any time
in which any performer, whether entertainer, employee, patron
or guest, participating directly or indirectly, sings or speaks
any obscene or indecent words, or performs any lewd or indecent
acts.,
(f) No entertainment shall be conducted at any time
in which any performer impersonates, by means of costumes or
dress, a person of the opposite sex.
(g) No establishment operating under a Cafe Enter-
tainment Permit shall permit the premises to be used for the
purpose of conducting a private club between the hours of 1:45
A.M. and 6:00 P.M. of any day.
(h) No person shall be employed at, or permitted to
remain on, the premises as entertainer, employee or patron,
whose activities or conduct encourages, promotes or condones
the congregation thereat of homosexuals, lesbians or persons
pretending to be such.
(1) No female person, whether employee, entertainer
or patron shall, at any time, expose the breast, buttocks, or
other private parts for public view.
(j) No establishment shall permit or condone, at any
time, any boisterous, disorderly or immoral conduct on the
premises.
(k) No establishment shall, at any time, permit an
intoxicated person to enter, or remain on, the premises.
(1) No person shall, at any time, in the course of
any entertainment participated in by him or her as a performer,
remove from his or her person any article of clothing other
than a hat, coat, cape, scarf, necktie, gloves or shoes.
(m) No employee at any establishment where alcoholic
beverages are served shall, at any time, accept or solicit for
himself or herself drinks of alcoholic beverages from any patron
at the place where he or she is employed.
(n) The applicant shall comply with all regulations,
ordinances and laws of the City of Azusa, State of California,
and United States of America.
(o) These regulations shall be posted in a conspicuous
place available to entertainers and employees, but need not be
in open view to the general public.
Adopted and approved this 2nd day of December ,
1968.

adopted by the City Council of the City of Azusa at a regular
meeting thereof held on the 2nd day of December , 1968,
