HomeMy WebLinkAboutResolution No. 55460 0 RESOLUTION NO. 5546 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING ITS INTENTION TO VACATE A CERTAIN PORTION OF McKEEVER AVENUE SUBJECT TO THE RESERVA- TION AND EXCEPTION OF CERTAIN EASEMENTS. The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council of the City of Azusa, upon recommendation of the Planning Commission, does hereby declare its intention to vacate a certain portion of McKeever Avenue in the City of Azusa as shown on a map or plan on file in the office of the City Clerk to which reference is made for further particulars, described as follows: That portion of McKeever Avenue as shown in Book 361, Page 50 of Maps of said County, lying easterly of the Northerly prolongation of the Westerly line of Lot 18, of Tract 13791, as recorded in Book 361, Page 50 of Maps of said County. SUBJECT TO AND RESERVING AND EXCEPTING from said vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, renew and enlarge therein lines of pipe, conduits, cables, wires and poles, and other convenient structures, equipment and fixtures for the operation and distribution of storm drain, sewer, water and gas pipe lines, and traffic signal conduits, and electric energy, telegraph and telephone poles and wires and cables. The City Council does hereby determine that the public convenience and necessity require the reservation of the rights, easements and rights of way enumerated above. These proceedings for the vacation of said portion of McKeever Avenue are taken subject to such reservations and exceptions. SECTION 2, The City Council of the City of Azusa does hereby elect to proceed to vacate the said portion of said street under the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. SECTION 3. The hour of 8:00 otclock P.M. on Monday, the 7th day of April, 1969, is hereby fixed as the time and the Council Chamber in the Azusa Auditorium at 213 East Foothill, Azusa, Calif- ornia, is hereby fixed as the place for hearing all persons inter- ested in or objecting to the proposed vacation of said portion of said street. SECTION 4. Notices of Street Vacation shall be posted by the Street Superintendent in the manner prescribed by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify tothe adoption of this resolution and shall cause the same to be published within fifteen days of its adoption in one regular issue of.the Azusa Herald, a newspaper of general circulation, printed, published and circulated in the City of Azusa.
