A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA GRANTING A VARIANCE. (V-221 - R. G.
Hohman Enterprises)
The City Council of the City of Azusa does resolve as
follows:
SECTION 1. It is hereby found and determined that
application for a variance to allow a service station site on a
lot of 20, 160 square feet in lieu of the 21,000 square feet
minimum site size required for such use in the Freeway Service
Zone for real property located at 137 East First Street, described
as Lots 17, 18 and a portion of Lot 19, block 77, map of Azusa,
was duly made, that a hearing thereon was duly held by the Plan-
ning Commission after due and legal notice thereof, that the
Planning Commission denied said variance by its Resolution No. 766,
that said action was appealed to the City Council by the applicant,
and that the City Council has held a hearing thereon after due and
legal notice thereof.
SECTION 2. It is hereby found by the City Council that:
a. The strict application of the service station site
size requirements of the Freeway Service Zone set
forth in Section 9221.70 of the Azusa Municipal
Code would be both a practical difficulty and an
unnecessary hardship inconsistent with its general
purpose and intent due to the comparatively small
amount of the deficiency and the fact that the
only way the deficiency could be made up would be
to require purchase of a substantially greater
amount of land;
b. There are exceptional circumstances and conditions
applicable to said real property and its intended
use and development not generally applicable to
other property in the same zone or neighborhood in
that this is the only parcel intended for such use
which had such a small portion thereof taken by the
State of California for freeway purposes, which taking
was in process prior to adoption of said Section
9221.70 of said Municipal Code,;
c. The grant of the variance as requested will not be
materially detrimental to the public welfare or
injurious to the property or improvements in the
zone or the neighborhood in which said real property
is located due to the comparatively small deficiency
in lot size, the location of said real property, and
the fact that no objection was made to the proposed
service station use on said real property;
d. The granting of the variance as requested will not
be contrary to the objectives of any part of the
Master Plan.
•SECTION 3. The variance applied for, reducing the minimum
site size requirement for an automobile service station with respect
to the above-described real property from 21,000 square feet to
20,160 square feet is hereby granted subject to the following
conditions:
a. A conditional use permit for the operation of
said automobile service station be obtained by
applicant;
b. All requirements of Planning Commission Resolution
No. 739 establishing basic development standards
for automobile service stations be complied with,
except for Section 3(a) thereof;
c. All requirements of Planning Commission Resolution
No. 749 requiring security to guarantee removal of
structures and equipment upon termination of a
service station use be complied with.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution and shall transmit a certified copy thereof to
applicant.
