RESOLUTION NO. 5625 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING ITS INTENTION TO VACATE A CERTAIN PORTION OF•FIFTH STREET SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS. The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council of the City of Azusa, upon recommendation of the Planning Commission, does hereby declare its intention to vacate a certain portion of Fifth Street in the City of Azusa as shown on a map or plan on file in the office of the City Clerk to which reference is made for further particulars, described as follows: The easterly 152 feet of Fifth Street, 60 feet in width, as dedicated on Tract No. lo66o in the City of Azusa as per map recorded in Book 164 pages 13 and 14 of Records, in the office of the County Recorder, County of Los Angeles, State of California. SUBJECT TO AND RESERVING AND EXCEPTING from said vacation the permanent easement and.right at any time, or from time to time, to construct, maintain, operate, replace, remove, renew and enlarge there- in lines of pipe, conduits, cables, wires and poles, and other convenient structures, equipment and fixtures for the operation and distribution of storm drain, sewer, water and gas pipe lines, and traffic signal conduits, and electric energy, telegraph and telephone poles and wires and cables, and the right of ingress and egress for the use of any fire hydrant on said real property. The City Council does hereby determine that the public convenience and necessity require the reservation of the rights, easements and rights of way enumerated above. These proceedings for the vacation of said portion of Fifth Street are taken sub- ject to such reservations and exceptions. SECTION 2. The City Council of the City of Azusa does hereby elect to proceed to vacate the said portion of said street under the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. SECTION 3. The hour of 8:00 o'clock P.M. on Monday, the 20th day of October, 1969, is hereby fixed as the time and the Council Chamber in the Azusa Auditorium at 213 East Foothill, Azusa, California, is hereby fixed as the place for hearing all persons interested in or objecting to the pro- posed vacation of said portion of said street. SECTION 4. Notices of Street Vacation shall be posted by the -Street Superintendent in the manner prescribed by Section X322 of the Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be pub- lished within fifteen days of its adoption in one regular issue 1 0 0 of the Azusa Herald, a newspaper of general circulation, printed, published and circulated in the City of Azusa. 1969. PROOF OF PUBLICA 0 „ , IF RESOLUTION NO. 5624 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FINDING THAT THE PUBLIC INTEREST AND CONVENIENCE REQUIRE THE SALE OF CERTAIN REAL PROPERTY DEDICATED TO PUBLIC USE AND OF ITS INTENTION TO SELL SAME. The City Council of the City of Azusa does resolve as follows: SECTION 1. Pursuant to Article 3, Chapter 5, Division 3, Title 4 of the Government Code, the City Council does hereby find that the public interest and convenience require the sale of that certain real property dedicated to public use, within the City of Azusa owned by -the City and more particularly described on Exhibit "A” attached hereto and incorporated herein by reference. SECTION 2. It is the intention of the City to sell said real property to Mr. and Mrs. Edward R. Seidner for the sum of $940.00 cash . SECTION 3. The hour of 8:00 P.M. in the Council Chambers located in the Azusa Auditorium at 213 East Foothill Boulevard, Azusa, California on October 6, 1969, is hereby fixed as the time and place for hearing protests to said sale. SECTION 4. The City Clerk is hereby directed to publish notice of said hearing by publishing this Resolution at least once in the Azusa Herald and Pomotropic, a semi-weekly news- paper published and circulated in the City of Azusa, and is further directed to post said notice for not less than 10 days in advance of said hearing in at least three conspicuous places upon said real property. SECTION 5. Final action on said sale will occur on October 7, 1969. At any time prior thereto any person interested may protest said sale. Said protest may be in writing and delivered to the City Clerk or may be oral at the meeting sche- duled in Section 3 above. SECTION 6. The City Clerk shall certify to the adoption of this Resolution. Adopted and approved this 15 day of September , 1969.
