HomeMy WebLinkAboutResolution No. 5576RESOLUTION NO. 5576 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA UPHOLDING REVOCATION OF A CERTAIN ENTERTAINMENT PERMIT. The City Council of the City of Azusa does resolve as follows: SECTION 1. After due hearing pursuant to Azusa Municipal Code Section 4299 with respect to the action of the Chief of Police revoking the entertainment permit of Diana DiLiberto (Permittee), doing business as "The Bunny Run", an establishment located at 633 East Foothill Boulevard in the City of Azusa, and having considered the evidence presented and the arguments of Permittee, it is hereby found (A) That said entertainment permit was issued to Permittee on February 18, 1969, with certain terms and conditions attached thereto, which terms and conditions are set forth in Resolution No. 5499 adopted by the City Council on December 2, 1968. (B) That subsequent to February 18, 1969, Permittee violated a.condition of her entertainment permit, subsection ('d) of said Resolution 5499, in that entertainers in said establishment mingled and associated with patrons thereof while dressed other than in conventional street clothes. (C) That subsequent to February 18, 1969, Permittee violated a condition of her entertainment permit, subsection (e) of said Resolution No. 5499, by the showing in said establishment when it was open for business, of a certain film in which a .young woman performer performed lewd and indecent acts. (D) That subsequent to February 18, 1969, Permittee violated a condition of her entertainment permit, subsection (i) of said Resolution No. 5499, in that female entertainers in said establishment exposed their breasts, buttocks and other private parts for public view. (E) That subsequent to February 18, 1969, Permittee violated a condition of her entertainment permit, subsection (j) of said Resolution No. 5499, in that the showing of said film and exposing of bodies by female entertainers as set forth in (C) and (D) above constitute permission and con- donation of immoral conduct on the premises. (F) That subsequent to February 18, 1969, Permittee violated a condition of her entertainment permit, subsection (1) of said Resolution No. 5499, in that in the course of entertainment participated in by a female performer, such performer removed from her person articles of clothing other than a hat, coat, cape, scarf, necktie, gloves or shoes. ct • (G) That subsequent to February 18, 1969, Permittee violated a condition of her entertainment permit, subsection (n) of said Resolution No. 5499, in that she violated certain regulations set forth in said Resolution No. 5499 as described in (B), (C), (D), (E), and (F) above; Section 4299 of the Azusa Municipal Code in that she conducted the establishment in an illegal, improper and disorderly manner in violation of terms and con- ditions attached to her entertainment permit; and that the activities portrayed in the film described in (C) above were obscene and consti- tuted acts of indecent exposure under the laws of the State of California. SECTION 2. It is further found by the City Council that each and every one of the individual findings set forth in Section 1 above, or any combination thereof is or are sufficient ground or grounds upon which to uphold the action of the Chief of Police in revoking said entertainment permit. SECTION 3. Based upon the above, the revocation of the entertainment permit of Diana DiLiberto, doing business as "The Bunny Run", is hereby upheld. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 7th day of May , 1969.
