HomeMy WebLinkAboutResolution No. 5696RESOLUTION NO. ;,6g6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ORDERING THE VACATION OF A CERTAIN PORTION OF FIFTH STREET SUBJECT TO THE RESERVATION AND EXCEPTION OF CER- TAIN EASEMENTS. The City Council of the City of Azusa does resolve as follows: SECTION 1 . WHEREAS, proceedings were instituted by the City Council to vacate a certain portion of Fifth Street under the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California, and a resolution of its intention to vacate said portion of said street was adopted and approved on the 15th day of September, 1969, and a hearing fixed for the 20th day of October, 1969, and notice was given in accordance with Section 8322 of the Streets and Highways Code of the State of California, and after hearing held as scheduled and there having been no valid protests or reasons given as to why said portion of said street should not be vacated, and from all the evidence submitted, the City Council does hereby find that said portion of said street is unnecessary for present or prospective public street purposes; therefore, that certain portion of Fifth Street hereinafter described be and the same is hereby vacated, subject to the reservation of the rights, easements and rights of way herein- after set forth to wit: The westerly 152 feet of Fifth Street, 60 feet in width, as dedicated on Tract No. 10660 in the City of Azusa as per map recorded in Book 164 pages 13 and 14 of Records, in the office of the County Recorder, County of Los Angeles, State of California. SUBJECT TO AND RESERVING AND EXCEPTING from said vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, renew and enlarge therein lines of pipe, conduits, cables, wires and poles, and other convenient structures, equipment and fixtures for the operation and distribution of storm drain, sewer, water and gas pipe lines, and traffic signal conduits, and electric energy, telegraph and telephone poles and wires and cables, and the right of ingress and egress for the use of any fire hydrant on said real property. SECTION 2. Resolution No. 5635, adopted on the 20th day of October, 1969, is hereby rescinded for the purpose of correcting an inaccurate legal description of the above vacation contained therein. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and shall cause a certified copy thereof attested by said City Clerk under the seal of the City to be recorded in the office of the County Recorder of Los Angeles County.
