RESOLUTION NO. 5794
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA DENYING A REQUEST FOR A VARIANCE. (Variance
Case No. V-251 - Soelberg)
The City Council of the City of Azusa does resolve as
Follows:
SECTION 1. An application for a variance to permit the
construction of an apartment complex in a C-3 Zone on the southerly
310 feet of the property located on the southwest corner of Alosta
and Calera Avenues and more particularly described in Variance Case
Application No. V-251, having been duly heard by the Planning Com-
mission after proper notice, the Planning Commission having denied
said variance and the same having been appealed to the City Council,
after due notice and public hearings and re -reference to the Planning
Commission, the City Council finds that facts do not exist sufficient
to justify the granting of said variance and that said application
for a variance should be denied for the following reasons:
1. The strict application of the zoning ordinance will
not deprive the owner of any privilege enjoyed by other property in
the vicinity and in the same zone. There are no special circumstances
applicable to the property such as its size, shape or location which
would justify the granting of the variance requested.
2. There is no substantial property right which is denied
to the subject property which is possessed by other properties in the
vicinity and in the same zone. The requested use is not an authorized
use in the zone in which the property is located and the granting of
the variance would authorize a use of the property which is inconsistent
with the proposed use of adjoining property which is similarly zoned.
3. The granting of the variance, as requested, would be
materially detrimental to the public welfare and injurious to the
immediate area and surrounding zone, The proposed apartment complex
would add to the concentration of families living in the neighborhood
and would contribute to the overcrowding of public facilities in the
area.
SECTION 2. Variance Application No. V-251 (Soelberg) to
permit the construction of an apartment complex on property zoned
C-3 located on the southerly 310 feet of the property at the south-
west corner of Alosta and Calera Avenues in the City of Azusa is
hereby denied.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution.
