HomeMy WebLinkAboutResolution No. 5757• 0 .. i0 RESOLUTION NO. 5757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY AND FACILITIES FOR THE PURPOSE OF CONDUCTING, TRANSMITTING, AND DISTRIBUTING ELECTRIC ENERGY FOR THE USE OF SAID CITY. The City Council of the City of Azusa does resolve as follows: SECTION 1. That the City Council hereby finds, determines, and declares that the public interest and necessity require the acquisition for the use of the City of Azusa of the hereinafter described property and facilities now owned by Southern California Edison Company, a corporation, for the purpose of conducting, transmitting, and distributing electric energy and all uses appurtenant thereto. That the acquisition by the City of said property and facilities as hereinafter described is for the purpose of conducting, transmitting, and distributing electric energy to the City and its inhabitants and is necessary for the proper development of the City, and that the use and development of said property and facilities has been planned in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that in order to acquire for the use of the City said property and facilities for conducting, transmitting, and distributing electric energy for the use of the same for said purposes, the public interest, convenience, and necessity require the acquisition of said property and facilities by the City of Azusa as hereinafter described, and the City Council hereby declares it is the intention of the City of Azusa to acquire full title free and clear of all liens and encumbrances to said property and facilities by condemnation in accordance with the provisions of the Code of Civil Procedure, the Govern- ment Code, the Public Utilities Code, and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said property and facilities, the acquisition of which is required by the public interest, con- venience, and necessity in the wanner and for the purpose set forth in Sections 1 and 2 hereof are described as follows: Those certain electrical distribution and communication facilities of the Southern California Edison Company more particularly des- cribed in Exhibit "A" & Exhibit "B" attached hereto. SECTION 4. That the City Attorney of the City of Azusa and Burke, Williams & Sorensen, are hereby authorized, empowered, and directed to prepare, institute, and prosecute in the name of the City of Azusa such proceedings in the pro- per Court having jurisdiction thereof as are necessary for the condemnation of said property and facilities described in Section 3 of this Resolution. SECTION 5. The City Clerk shall certify to the adoption of this Resolution. 1970.
