HomeMy WebLinkAboutResolution No. 5841RESOLUTION NO. 5841 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE. (Variance Case V-260 - John Rogers) The City Council of the City of Azusa does resolve as follows: SECTION 1. An application for a variance permitting an over height fence along the rear property line and along the rear 8 feet of the side property lines on property located at 170 North Viceroy Avenue, legally described as Lot 39, Tract No. 20495, having been duly heard by the Planning Commission after proper notice, and the Planning Commission having granted the said variance subject to certain conditions, and the applicant having appealed from the con- ditions established by the Planning Commission to the City Council, and an adjoining property owner having appealed from the granting of said variance, the City Council, after due notice and public hearing, finds that sufficient facts exist to justify the granting of the variance applied for subject to the conditions hereinafter specified. 1. The strict application of the zoning ordinance to the property in question would result in practical difficulties and unnecessary hardships in so far as the property owner is concerned. 2. There are special circumstances applicable to the property which do not apply generally to other property in the same zone in that the property backs up to a major or secondary highway. 3. The granting of the variance will not be materially detrimental to the public welfare and is not contrary to the objectives of any part of the Master Plan. SECTION 2. The appeal of A. J. Wiggirs from the granting of said variance is hereby denied. SECTION 3. Variance Application No. V-260 (John Rogers) permitting an over height fence along the rear property line and along the rear 8 feet of the side property lines on property located at 170 North Viceroy Avenue, Lot 39, Tract No. 20495, is granted subject to the following conditions: 1. That any and all fencing added along .the rear property line be of the same material, construction and color as the existing fence. 2. Height of rear wall shall not exceed 7' 411. 3. Height of side yard fence shall be tapered from the 714" height to the legal limit of 6' within an 8' span. 4. Fencing in excess of 61 shall meet all Building and Engineering requirements. 5. The fencing along the sides shall be of the same material, construction and color as the existing fence and if, at any time, the adjacent property increases the height of their rear fence, to sufficiently screen from public view along Citrus Avenue, this over height portion of the side fence shall be removed within 60 days. 0 SECTION 4.The variance hereby granted shall become void and ineffective for any purpose unless it is utilized within 6 months after the effective date of this resolution and the conditions thereof fully complied with. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
