A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA DENYING A REQUEST FOR A VARIANCE. (Variance
Case No. V-259 - Ralph Poole)
The City Council of the City of Azusa does resolve as
follows:
SECTION 1. An application for a variance permitting a
reduced rear yard setback and a reduced side yard setback on property
located at 1033 Galatea Street, legally described as Lot 111 of Tract
No. 17939, having been duly heard by the Planning Commission after
proper notice, the Planning Commission having granted that portion of
the variance applied for permitting a reduced rear yard setback of
20' 10", and denying that portion of the variance applied for per-
mitting a reduced side yard setback, and that portion of the variance
applied for denying the reduced side yard setback having been appealed
to the City Council, after due notice and public hearing, the City
Council finds that facts do not exist to justify the granting of the
reduced side yard setback applied for and that said portion of the
variance application should be denied for the following reasons:
1. The strict application of the zoning ordinance will
not deprive the owner of any privilege enjoyed by other property in
the vicinity and in the same zone. There are no special circumstances
applicable to the property such as its size, shape or location which
would justify the granting of the variance requested.
2. There is no substantial property right which is denied
to the subject property which is possessed by other properties in the
vicinity and in the same zone.
3.. The granting of the variance as requested would be
materially detrimental to the public welfare and injurious to the
immediate area and surrounding zone. The approval of the reduced side
yard setback would impair the ability of the City to provide adequate
fire protection and would contribute to the congestion in the area.
SECTION 2. That portion of Variance Application No. V-259
(Ralph Poole) permitting a reduced side yard setback on property located
at 1033 Galatea Street and legally described as Lot 111, Tract No.
17939, is hereby denied.
SECTION 3. The City Clerk shall certify to the adoption of
this resolution.
Adopted and approved this 1st day of February , 1971.
I hereby certify that the foregoing resolution was duly
adopted by the City Council of the City of Azusa at a regular meeting
thereof held on the 1st day of February , 19712 by the following
vote of the Council:
AYES: Councilmen: Rubio, Decker, Snyder, Clark, Solem
NOES: Councilmen: None
ABSENT:Councilmen: None
