HomeMy WebLinkAboutResolution No. 5929RESOLUTION NO. 5929 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE.(Variance Case No. V-278 - Jerry Freudenberg) The City Council of the City of Azusa does resolve as follows: SECTION 1. An application for a variance to permit the construction of a two-story single family residence containing approximately 1000 square feet with an attached two -car garage on a lot containing 5,055 square feet on property located at 207 North Orange Avenue, having been duly heard by the Planning Commission after proper notice, and the Planning Commission having denied the said variance, and the applicant having appealed from the denial to the City Council, the City Council, after due notice and public hearing, finds that sufficient facts exist to justify the granting of the variance subject to the conditions hereinafter specified: (a) The strict application of the zoning ordinance to the property in question would result in practical difficulties and unnecessary hardships in so far as the property owner is concerned in that the lot is a sub -standard parcel remaining after the con- struction of the Foothill Freeway and cannot be used for the pur- poses for which it is zoned under the existing ordinances of the City. (b) There are special circumstances applicable to the property in question which do not apply generally to other property in the same zone inasmuch as the property is triangularly shaped with 120 feet of frontage on Orange Avenue but consists of an area of 5,055 square feet. (c) The granting of a variance will not be materially detrimental to the public welfare and is not contrary to the objectives of any part of the Master Plan inasmuch as the use of the property for single family residential purposes is consistent with the use being made of the other properties.in the same vicinity. SECTION 2. Variance Application No. V-278 (Jerry Freudenberg) to permit the construction of a single family two- story residence with an attached two -car garage on a lot containing 5,055 square feet located at 207 North Orange Avenue is granted. SECTION 3. The variance hereby granted shall become void and ineffective for any purpose unless it is utilized within six months after the effective date of this resolution and the conditions thereof fully complied with. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 20th day of December , 1971.
