adoption of this resolution and shall deliver a certified
copy thereof to the City Treasurer and shall retain a
certified copy thereof in his own records.

RESOLUTION NO. 5954
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA NOTIFYING THE LOCAL AGENCY FORMATION
COMMISSION OF LOS ANGELES COUNTY OF THE CITY'S
OPPOSITION TO THE REQUEST OF THE CITY OF SIERRA
MADRE TO BE DETACHED FROM THE SAN GABRIEL VALLEY
MUNICIPAL WATER DISTRICT.
WHEREAS, through the joint efforts of the inhabitants and
City Councils of the Cities of Alhambra, Azusa, Monterey Park and Sierra
Madre, the San Gabriel Valley Municipal Water District was created to
provide for the supplemental water needs of the District's inhabitants,
and
WHEREAS, the District has heretofore entered into a contract
with the State of California, Department of Water Resources, for the
delivery of 28,800 acre feet per year of supplemental water from the
State Project, for delivery at Devils Canyon in San Bernardino County,
and
WHEREAS, on October 5, 1971, at a Special District Election,
the electors within the District, by the affirmative vote of 76.8%,
approved the issuance of $17.5 million of District General Obligation
Bonds to transport supplemental water from San Bernardino County to
the area of the District, and
WHEREAS, bond funds are now being spent by the District for
the preparation of plans and specifications for the construction of the
pipeline required for the delivery of supplemental water pursuant to the
State contract. Upon the completion of the pipeline the estimated
supplemental water requirements through the year 2000 for the inhabitants
of the District will be provided, and
WHEREAS, the exclusion of the City of Sierra Madre from the
District will deprive the City of the means of meeting its supplemental
water requirements, and
WHEREAS, the exclusion of the City of Sierra Madre from the
District could and should only be done upon the basis that the taxable
property in the City would continue to be liable for its proportionate
share of the cost of the authorized bond issue and the cost of meeting
the District's long-term commitment under the State water contract.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Azusa as follows:
1. The City Council of the City of Azusa hereby expresses
its opposition to the detachment of the City of Sierra Madre from the
San Gabriel Valley Municipal Water District.
2. That if detachment is authorized, the Local Agency
Formation Commission establish conditions which may be necessary to
protect the long-term interests of the remaining area of the District
and that the taxable property in the City of Sierra Madre continue to
be liable for taxation for the payment of its proportionate share of
the bonded indebtedness of the District and of the cost of purchasing
water under the State contract.
3. The City Clerk is directed to transmit a certified copy
of this resolution to the Executive Officer of the Local Agency Formation
Commission.
