HomeMy WebLinkAboutResolution No. 6022RESOLUTION NO. 6022 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING AN APPEAL FROM THE GRANTING OF A VARIANCE AND APPROVING THE ACTION OF THE PLANNING COMMISSION. (Variance Case No. V-315 - Salvador Franco) The City Council of the City of Azusa does resolve as follows: SECTION 1. An application for a variance to reduce the side yard set back along the north property line from 5 feet to 1 foot on property located at 123 North San Gabriel Avenue, having been duly heard by the Planning Commission after proper notice, and the Planning Commission having granted the said variance„authorizing a 4 foot set back, and the action of the Planning Commission having been appealed to the City Council, the City Council, after due notice and public hearing, finds that the appeal should be denied and that sufficient facts exist to justify the granting of the variance subject to the conditions here- inafter specified: a The strict application of the ri zoi:- ordinance to.the property in question p on would result in practical difficunitties and"unnec- essary hardships in so far as the property owner is concerned in that the garage as built is set back 4 feet from the north property line. (b) There are special circumstances applicable to the property in question which do not apply generally to other property in the same zone. (c) The granting of a variance will not be materially detrimental to the public welfare and is not contrary to the objectives of any part of the Master Plan inasmuch as the use of the property is consistent with the use being made of the other properties in the same vicinity. SECTION 2. The appeal from the granting of Variance Application No. 315 (Salvador Franco) to reduce the side yard set back along the north property line from 5 feet to 1 foot on property located at 123 North San Gabriel Avenue is denied and the action of the Planning Commission in the granting of said variance (Resolution No. 998) is approved. SECTION 3. The variance hereby approved shall become void and ineffective for any purpose unless it is utilized within six months after the effective date of this resolution and the conditions thereof fully complied with. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 5th day of September 1972. J.
