RESOLUTION NO. 6127
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA GRANTING A VARIANCE. (V-355 - Anthony
Arcone)
The City Council of the City of Azusa does resolve as
follows:
SECTION 1. An application for a variance to permit a
single car garage instead of the required two -car garage in an R -lc
Zone, on property known as 902 East Nearfield Street and legally
described as Lot 50, Tract No. 16435, having been duly heard by the
Planning Commission after proper notice, and the Planning Commission
having denied the said variance, and the applicant having appealed
from the denial to the City Council, the City Council after due
notice and public hearing, finds that sufficient facts exist to
justify the granting of the variance subject to the conditions
hereinafter specified. The City Council further finds as follows:
(a) The strict application of the provisions of the
zoning title would result in practical difficulties and unnecessary
hardships inconsistent with the general purpose and intent of the
title.
(b) There are exceptional circumstances or conditions
applicable to the property involved or to the intended use or
development of the property that do not apply generally to other
property in the same zone or neighborhood.
(c) The granting of such variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the zone or neighborhood in which the property is
located.
(d) The granting of such variance will not be contrary
to the objectives of any part of any Master Plan.
SECTION 2. Variance Application No. V-355 (Anthony
Arcone) to allow a single car garage instead of the required two -car
garage is granted subject to the following condition:
(a) Within thirty days after the date of this resolution
the garage is made functional for at least eight feet in width.
SECTION 3. The variance hereby granted shall become void
and ineffective for any purpose unless it is utilized within six
months after the effective date of this resolution and the conditions
thereof fully complied with.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
Adopted and approved this 20th day of August, 1973.
