HomeMy WebLinkAboutResolution No. 6125RESOLUTION NO. 6125 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING ITS INTENTION TO VACATE AN ALLEY LYING SOUTH OF FOURTH STREET BETWEEN VIRGINIA AVENUE AND BARBARA AVENUE SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN RIGHTS AND EASEMENTS. The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council of the City of Azusa upon recommendation of the Planning Commission, does hereby declare its intention to vacate an alley lying south of Fourth Street between Virginia Avenue and Barbara Avenue, in the City of Azusa, County of Los Angeles, State of California, as shown on a map or plan on file in the office of the City Clerk to which reference is made for further particulars, bounded as follows: That portion of a public alley lying within Tract No. 7625 in the City of Azusa, State of California, as shown on the map recorded on Page 33, Book 73 of Maps recorded in the office of the Los Angeles County Recorder more closely described as follows: Beginning at a point in the westerly line of Lot*59 of said Tract No. 7625, lying southerly 23.82 feet from the northwesterly corner of said Lot 59; thence northerly along said westerly line 23.82 feet to said northwesterly corner; thence South 890 51, 20" West 15.00 feet to the northwesterly corner of Lot 33 of said Tract No. 7625; thence southerly along the easterly line of said Lot 33, 15.05 feet; thence in a southeasterly direction in a straight line to the point of beginning. Reserving and excepting from said vacation the permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of water lines, telegraphic and telephone energy, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon, and over a 3 foot wide strip of land along the westerly side of the part of the alley proposed to be vacated. The City Council does hereby determine that the public convenience and necessity require the reservation of the rights, easements, and rights-of-way enumerated above. These proceedings for the vacation of said alley are taken subject to such reservations and exceptions. SECTION 2. The City Council of the City of Azusa does hereby elect to proceed to vacate the said portion of said alley under the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. SECTION 3. The hour of 7:30 p.m., on �Tusday_,the 4th day of September , 1973, is hereby fixed as the time and the Council Chambers in the City Hall at 213 East Foothill Boulevard, Azusa, California, is hereby fixed as the place, for hearing all persons interested in or objections to the proposed vacation of said portion of said alley. 0 0 SECTION 4. Notices of Street Vacation shall be posted by the Street Superintendent in the manner prescribed by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published within fifteen (15) days of its adoption in one regular issue of the Azusa Herald, a newspaper of general circulation, printed, published, and circulated in the City of Azusa.
