HomeMy WebLinkAboutResolution No. 6103RESOLUTION NO. 6103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REQUESTING THE SOUTHERN PACIFIC TRANSPORTATION COMPANY TO REMOVE AND REPLACE ITS EXISTING TRACK FOR THE PURPOSE OF CONSTRUCTION OF STORM DRAIN FOR IMPROVEMENT OF IRWINDALE AVENUE WHEREAS, the County of Los Angeles, as part of its Cash Contract No. 2439, pro- poses to improve Irwindale Avenue between Foothill Boulevard and Arrow Highway. Southern Pacific transportation Company's track crosses Irwindale Avenue approxi- mately 100 feet north of Gladstone Street, (Crossing No. BBQ -503.92-C), within the aforesaid County project. As part of the improvement the County of Los Angeles proposes to construct a storm drain in Irwindale Avenue which will pass under the tracks of the Southern Pacific Transportation Company and which will require removal and replacement of the existing track and pavement. The construction of this storm drain will be of benefit to the City of Azusa in that it will aid in the protection of the roadway and adjacent private property against flooding under storm flow conditions. The Southern Pacific Transportation Company's crossing lies entirely within the City of Azusa and was constructed under City Franchise Ordinance No. 470 which states in part, "It is further made a condition hereof that the City of Azusa expressly reserves the right to grade, sewer, pave, macadamize, repair, improve or alter said streets or any part thereof, and to lay down pipes for water, gas or other purposes therein, all such4ork to be done by said City in a manner to injure or obstruct the track and business of said railroad company as little as possible, and in no case so as to endanger said railroad or the operation of trains thereon. The track shall be kept constantly in repair by grantee in and along said streets." The Ordinance also states that, "The grantee at its own expense agrees to make, provide and maintain all stone drain and culverts under and across its track at crossings or streets where necessary in the opinion of the City Council and when requested by said Council." NOW, THEREFORE BE IT RESOLVED THAT: 1. The City Council of the City of Azusa does hereby request and require the Southern Pacific Transportation Company, at its own expense, to remove and replace its existing track and adjacent pavement within the limits of Cash Contract No. 2439 as may be necessary to construct the storm drain which is part of the County project, all as provided by City Franchise Ordinance No. 470., 2. Such removal and replacement shall be coordinated with the work being performed by the County of Los Angeles under its Cash Contract No. 2439. 3. The City Clerk is directed to forward a certified copy of this Resolution to the Southern Pacific Transportation Company. Adopted and approved this 18th day of June , 1973.
