HomeMy WebLinkAboutResolution No. 6279f • RESOLUTION N0. 6279 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A CONDITIONAL USE PERMIT (C-148 - Southwestern Portland Cement Co.) The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Southwestern Portland Cement Co, requesting the granting of a Conditional Use Permit for the modification and improvement of an existing sand and gravel processing plant in the M-2 Zone, located on property at 1201 West Gladstone Avenue which is more particularly described in the application on file with the Planning Commission, that hearings thereon were duly conducted by the Planning Commission and the Planning Commission approved the application, that the matter was called up by the City Council, and the City Council held a hearing thereon and proper and legal notice of the hearing was duly given. SECTION 2. Conditional Use Permit No. C-148 is hereby granted pursuant to the provisions of the Azusa Municipal Code, provided that the physcial development of the property included therein shall conform to,said application and the conditions, attached hereto, marked Exhibit 'A", and by this reference in- corporated herein, which, except as otherwise expressly indicated, shall be fully performed and completed, and the violation of any of which shall be grounds for the revocation of said Conditional Use Permit by the Planning Commission or City Council. SECTION 3. The permit hereby granted is conditional upon the privileges being utilized within 6 months after the effective date thereof, and if it is not utilized or construction work is not begun within said time and carried on diligently in accordance with the conditions imposed in Section 2 hereof, this permit shall become void, and any privilege granted hereby shall be deemed to have lapsed. SECTION 4. The Conditional Use Permit hereby granted shall cease to be effective for all purposes 10 years from and after February 3, 1975, unless the same is extended upon application therefor and after notice and hearing in the manner provided for hearing original applications, by the Planning Commission and City Council. Any extension hereof may be upon such terms and conditions as may be prescribed by the Planning Commission or City Council and which are required for the protection of the public peace, health or safety. SECTION 5. The Planning Commission shall establish an administrative procedure for the periodic monitoring of the use of the property for compliance with the conditions of this permit. SECTION 6. The Environmental Impact Report for the project as prepared and as approved by the Planning Commission is hereby found and determined to have been prepared in accordance with the requirements of the California Environmental Quality Act of 1970, is adopted and ordered filed. SECTION 7. The City Clerk shall certify to the adoption of this resolution and shall transmit a certified copy to the applicant and to the Planning Director. Adopted and approved this 3rd day of February 1975• Mayor I hereby certify that the foregoing resolution was duly adopted by the City Council of the City of Azusa at a regular meeting thereof held on the 3rd day of February 1975, by the following vote of the Council: AYES: Councilmen: Rubio, Solem, Cruz, Arkison, Decker NOES: Councilmen: None ABSENT: Councilmen: None -2- C-Ity Clerk LEGAL DESCRIPTION A portion of Lots 26, 27, 28, 29, 30, 46, 47 and 48 of Subdivision No. 2, Azusa Land & Water Company as recorded in Miscellaneous Records Book 43, Page 94 in the office of the County Recorder, County of Los Angeles, State of California. CONDITIONS Gladstone Street: 1. Maintain present landscaped area at entrance to plant. Jackson Street: 1. Existing berm along east side of subject property shall be extended to southeast corner of property in question and to the north side of Paramount Street to form a.continuous berm along the entire easterly property line. Said berm shall be a minimum of 10 feet high and properly maintained at all times. 2. Existing chain link fence shall be properly maintained including painting or landscaped or replaced with a 6 foot high decorative masonry wall with inset panels along entire street frontage. 3. Area between curb and fence (or masonry wall) shall be properly landscaped and adequately maintained at all times. 4. Faces of berm shall be adequately landscaped and properly maintained at all times. 5. A tree row shall be planted along the top of berm to form additional screening. Said trees shall be properly maintained, including replacement as necessary, at all times. 6. All landscaping, including watering systems, shall be approved by the Azusa Park Department. Adjacent industrially zoned property to the east: 1. A berm a minimum of 10 feet high shall be provided between Paramount Street and the north side of First Street. This berm may consist of finished material forming a stockpile and within 3 years of date of approval be re- placed with a permanent berm. If berm is formed of a stockpile it shall not be removed for more than 24 hours. Upon completion of permanent berm a tree row shall be planted along the top to form additional screening. Said tree row shall be properly maintained, including replacement as necessary, at all times. When adjacent industrially zoned property is developed the face of said berm shall also be adequately landscaped and properly maintained at all times. General• 1. Loading and or stockpiling operations shall not take place on the easterly portion of subject property adjacent to the berm along Jackson Avenue between the hours of 7 p.m. and 6 a.m. 2. Provide a noise barrier (material to be determined after experiments are con- ducted) easterly of the secondary crushing facility. 3. Loaders and other equipment shall not use horns, bells, etc., as a method of signaling trucks between the hours of 2 hour after sunset and z hour prior to sunrise. The use of horns on equipment or in the plant area between these hours shall be only as required in an emergency or as required by the Federal or State safety laws. 4..Morns or loudspeakers shall not be used as a method of 'sounding the telephone. 5. All vehicular traffic entering or exiting subject property shall do so from the west side or Gladstone Street only, except when waived under certain con- ditions for.emergencies or the benefit of the City. 6. Truck speeds inside the yard shall not exceed 15 mph. 7. All trucks, loaders and other equipment shall be equipped with adequate noise reducing mufflers: 8. All entrances to the plant and haul roads in and around the plant shall be maintained in such a manner as to be in compliance with LACAPCD Rules and Regulations. Maintenance is to include repaving and repairing as necessary and washing and sweeping as may be required. 9. The concrete batching plant shall be equipped with an LACAPCD approved dust collection control system. 10. All open truck carriers not carrying material required to be delivered in a dry condition shall be sprayed with water prior to, or immediately upon, leaving loading area. 11. In the garage shop operations the use of the dynamometer, reving up of the engines for tuning, loud hammering and steam cleaning shall not take place between the hours of 9 p.m. and 6 a.m. 12. Plant operating hours shall be from 6 a.m, to 10 p.m. Monday through Friday and 6 a.m, to 5 p.m, on Saturday. There shall be no plant operation or excavation on Sundays or the following holidays: New Years Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day and Christmas. Additional operation outside of the stipulated operating hours may be permitted for the following reasons: 1)where a continuous pour of concrete is required; 2) where required -by public authorities; 3) where necessary due to public emergency as declared by governmental agency. 13. Using the Weighted "A" Scale the maximum noise level from any source on the property, when measured at the property line, shall not exceed the follow- ing maximums: 6 a.m. to 10,p.m. 65 dbA 10 P.M. to 6 a.m. 50 dbA 14. All quarrying, crushing and related rock processing shall be subject to full compliance with ail LACAPCD requirements. 15. The conditions contained herein shall not pre-empt full compliance by the applicant with any future regulations adopted on a Citywide basis relative to dust, noise, etc., that may be more stringent. Time limits for compliance: 1. Hours of operation - effective immediately. 2. Approved dust control for the crushing, handling and processing equipment - effective at time modified plant goes into operation. 3. Construction of berms along easterly property line between Gladstone Street and Paramount Street.- completed and continuously maintained within one year of date CUP is approved. 4. Planting of tree row along top of berm along easterly property line between Gladstone Street and Paramount Street - completed within one year from date CUP is approved. 5. Construction of berm along easterly property line between Paramount Street and First Street - completed and continuously maintained within 3 years of date CUP is approved. 6. Planting of tree row along top of berm along easterly property line between Paramount Street and First Street - completed within 3 years of date CUP is approved. 7. Landscaping of berm along easterly property line between Paramount Street and First Street - shall be landscaped and continuously maintained when adjacent manufacturing zoned property is developed. " 8. Development of fence or wall and landscaping of berm and parkway areas adjacent to residential zones - within 180 days of completion of storm drain project or within 12 months of date CUP is approved. 9. Maximum noise level - effective 18 months from date CUP is approved. r
