RESOLUTION NO. 6339
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA DECLARING ITS INTENTION TO VACATE A
CERTAIN PORTION OF SAN GABRIEL AVENUE AND
FIXING A TIME AND PLACE FOR A HEARING THEREON.
The City Council of the City of Azusa does resolve as
follows:
SECTION 1. The City Council of the City of Azusa, subject
to the recommendation of the Planning Commission, does hereby declare
its intention to vacate a portion of San Gabriel Avenue between First
Street and Foothill Freeway in the City of Azusa, County of Los Angeles,
State of California, as shown on a map or plan on file in the office
of the City Clerk to which reference is made for further particulars,
bounded as follows:
A portion of San Gabriel Avenue as shown in Tract No.
13963 recorded in Map Book 280, pages 20 and 21, more
particularly described as follows:
That portion of San Gabriel Avenue lying between the
prolongation of the Southerly right-of-way line of First
Street (80 feet wide) and the Northerly right-of-way
of the 210 Freeway as it existed on September 22, 1975.
Reserving and excepting from said vacation the permanent
easement and right at any time or from time to time,
to construct, maintain, operate, replace, remove, and
renew sanitary sewers and appurtenant structures thereof
and to construct, maintain, operate, replace, remove,
renew, and enlarge lines of pipe, conduits, cables, wires,
poles, and other convenient structures, equipment and
fixtures for the operation of water lines, telegraphic
and telephone energy, including access and the right to
keep the property free from inflammable materials, and
wood growth, and otherwise protect the same from all
hazards in, upon, and over the street or part thereof
proposed to be vacated.
The City Council does hereby determine that the public
convenience and necessity require the reservation of the rights, ease-
ments and rights-of-way enumerated above. These proceedings for the
vacation of said portion of San Gabriel Avenue are taken subject to
such reservations and exceptions.
SECTION 2. The City Council of the City of Azusa does hereby
elect to proceed to vacate the said portion of said street under the
provisions of Part 3, Division 9 of the Streets and Highways Code of
the State of California.
SECTION 3. The hour of 7:30 P.M. on Monday, the 3rd day
of November, 1975 is hereby fixed as the time and the Council Chambers
in the City Hall at 213 East Foothill Boulevard, Azusa, California,
is hereby fixed as the place for hearing all persons interested in or
objecting to the proposed vacation of said portion of said street.
SECTION 4. Notices of street vacation shall be posted by
the City Engineer in the manner prescribed by Section 8322 of the
Streets and Highways Code of the State of California.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution and shall cause the same to be published within
fifteen days of its adoption in one regular issue of the Azusa Herald,
a newspaper of general circulation, printed, published and circulated
in the City of Azusa.
