HomeMy WebLinkAboutResolution No. 6292RESOLUTION NO. 6292 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA URGING A CHANGE IN THE LAWS RELATING TO THE INCARCERATION AND RELEASE OF JUVENILES CHARGED WITH FELONIES. WHEREAS, the matter of juvenile crime has been brought into sharp public focus by reason of the large scale arrests of juveniles charged with the unlawful sale and possession of drugs, particularly in the public schools within the County of Los Angeles, and WHEREAS, many juveniles charged with drug violations have been released to their parents and guardians within a few hours following the time of their arrests and have the opportunity to again engage in the unlawful sale and possession of drugs, and WHEREAS, the City Council is mindful of the provisions of Section 628 of the Welfare and Institutions Code of the State of California which gives broad powers to a Probation Officer to release a minor to his parents or guardian in lieu of detention, and WHEREAS, the public interest demands that all citizens be protected from the commission of serious crimes by prior offenders, whether the prior offenders be minors or adults; NOW, THEREFORE, be it resolved by the City Council of the City of Azusa as follows: SECTION 1. The Legislature is hereby urged to amend the provisions of Section 628 of the Welfare and Institutions Code so that juveniles charged with felonies and other serious crimes, including the sale of marijuana and other prohibited drugs, be detained until a preliminary hearing is held by a Judge. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall transmit copies of this resolution to Go- vernor Edmund G. Brown, Jr., to Attorney General Evelle J. Younger, to District Attorney Joseph Busch, and to the members of the Senate and Assembly who represent the City of Azusa in the State Legislature.
