HomeMy WebLinkAboutResolution No. 6272RESOLUTION NO. 6272 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, ESTABLISHING THE WORK CYCLE FOR CERTAIN EMPLOYEES ENGAGED IN FIRE PROTECTION AND LAW ENFORCEMENT ACTIVITIES AND RESTATING POLICY WITH RESPECT TO OVERTIME WORK AND COMPENSATION THEREFOR. The City Council of the City of Azusa does resolve as follows: SECTION 1. The work cycle for employees of the City of Azusa and compensation for overtime work is hereby established as follows: A. The work period for all employees, except safety personnel, shall be 40 hours for a seven-day period beginning at 12:01 a. m, each Sunday morning. The work period will normally consist of five days a week and eight hours a day. B. Pursuant to Section 7 (k) of the Fair Labor Standards Act (FLSA), as amended in 1974, employees of the Fire Department engaged in fire protection activities will have a work period of 28 consecutive days beginning at 8:00 a. m. on December 29, 1974, and renewing each 28 days thereafter, a normal work shift will be 24 consecutive hours. C. Pursuant to Section TW( ofrthe FL•SA, as amended in 1974, employees of the Police Department engaged in law enforcement activities (sworn personnel) will have a work period of 28 consecutive days beginning at 12:01 a.m. on December 29, 1974, and renewing each 28 days thereafter. A normal work shift shall be eight hours per day. D. Daily hours of work (or shifts) for employees within depart- ments shall be assigned by the department head as required to meet the operational requirements of the department. E. Overtime Defined: (1) Emergency overtime is that which is required to preserve the public peace, health or safety. (2) Scheduled overtime is that which is required in all other instances. F. Overtime: 1. All employees, except safety personnel, shall receive overtime payment at the rate of one and one-half times the hourly rate of the employee for all hours worked in excess of 40 hours in any work period. 2. Employees engaged in fire protection activities shall receive straight time pay for all hours worked in a work period to a maximum of 240 hours. All hours worked in excess of 240 hours during any work period shall be compensated at one and one-half times the hourly rate of the employee. 3. Employees engaged in law enforcement activities shall receive straight time pay for all hours worked in a work period to a maximum of 240 hours. All hours worked in excess of 240 hours during any work period shall be compensated at one and one-half times the hourly rate of the employee. 4. Hours Worked: Holiday hours, sick leave hours and vacation hours shall not be considered hours worked in the computa- tion of premium (one and one-half) overtime pay. G. Cash payment for accrued compensatory time off due an employee at separation from City employment and earned prior to May 1, 1974, shall be at the hourly rate prevailing at the time the overtime was worked. The employee must request such payment of the City Administrator, after approval of the Department Head. H. Compensatory time off must be used by all employees, except for safety personnel by April 30, 1975. Safety personnel must use their compensatory time off prior to December 31, 1975. I. As required by 29 of R 553, issued by the Department of Labor pursuant to the 1974 amendment to the FLSA, it is the policy of the City of Azusa that voluntary shift trades between safety personnel in either the Fire Department or Police Department may be made only within the calendar year, January 1st through December 31st. All trades must be fulfilled within the calendar year. J. Authorization for Emergency Overtime may be ma. de by the Department Head, who shall, on the following work day, report to the City Administrator, the name of the employee, hours worked, and the reason the overtime was necessary. This procedure shall be followed on all overtime by Safety personnel. K. Authorization for Scheduled Overtime may be made by the Department Head only after receiving prior approval by the City Administrator. L. Employees, at the supervisory, administrative or executive level (i. e. - those above the first level of supervision) will not receive cash payment for overtime worked without recommendation of the Department Head and approval of the City Administrator. SECTION 2. Resolution No. 5925 of the City Council of the City of Azusa is hereby repealed. resolution. 1974. SECTION 3.
