HomeMy WebLinkAboutResolution No. 64810 0 RESOLUTION NO, 6481 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA. GRANTING A VARIANCE (Variance Application No. V-475, Hing Lee). The City Council of the City of Azusa does resolve as follows: SECTION 1. It is hereby found and determined that the application of Hing Lee for a variance to reconstruct an over -area directory sign of 416 square feet instead of the permitted 300 square feet in the Oak Tree Center located in the C-3 Zone was duly made, that hearing thereon was duly held by the Planning Commission, after legal notice thereof, that the Planning Commission denied said variance by its resolution, that said action was appealed to the City Council and the City Council held a hearing thereon, after legal notice thereof. SECTION Z. It is hereby found by the City Council that: a. There are exceptional circumstances applicable to the property which distinguish it from other properties in the same area in that the signs located in the Center are generally non -conforming in size and all signs in the Center require upgrading. b. The upgrading in the signs in the Center cannot be accomplished unless the variance applied for is granted. C. The granting of the variance will not be materially detrimental to the public welfare inasmuch as it will permit substantial improvement in the physical appearance of the Center. d. The granting of the variance will not adversely affect the General Plan. SECTION 3. A variance is hereby granted as applied for in Variance Application No. V-475. It is granted upon the following conditions, the violation of any one of which shall be grounds for the revocation of this variance by the Planning Commission and the City Council. This variance shall not be effective for any purpose until the owner of the property or his duly authorized representative has filed in the office of the Planning Department an affidavit stating that he is aware of, and accepts all of the following conditions of this variance: 1. All necessary permits shall be obtained. Z. All necessary building and fire regulations shall be met. 3. All enterprise identification signs within the Oak Tree Center shall be reduced in size to comply with Chapter 19. 50 of the Azusa Municipal Code and compliance shall be continuously maintained thereafter. 4. All temporary signs shall be removed as required by Chapter 19. 50 of the Azusa Municipal Code. 5. The directory sign of 416 square feet shall not be erected until Condition No. 3 hereof has been complied with and the enterprise identification signs within the Center comply with the requirements of Chapter 19. 50 of the Azusa Municipal Code. SECTION 4. The City Council hereby finds that the improvement for which this variance is granted will not adversely affect the environment of the area and that the negative declaration of environmental impact pre- pared by the Planning Department has been prepared in accordance with the California Environmental Quality Act of 1970 and the State Guidelines and is hereby approved. resolution.
