HomeMy WebLinkAboutResolution No. 6454t -- RESOLUTION NO. 6454 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ACCEPTING A CERTAIN GRANT OF EASEMENT AND DIRECTING THE RECORDING THEREOF, The City Council of the City of Azusa does resolve as follows: SECTION 1 That certain Grant of Easement executed by MONROVIA NURSERY COMPANY, a corporation under date of 30th day of July 1976, granting to the CITY OF AZUSA, a Municipal Corporation in Los Angeles County, California, its successors and assigns, the right to perpetual easement and right of way for public purposes for Utility in, on, over, under, across and along the following descri6ed real property situate in the CITY OF AZUSA, Los Angeles County, State of California to wit: Attached hereto as Exhibit A, and by this reference incorporated herein. Said Grant of Easement is hereby accepted, and the City Clerk is hereby authorized and directed to cause the some to be filed for record in the office of the County Records of said County. Cruz /5/ City C e of the City of Azusa EXHIBIT A One (1) strip of land twelve (12) feet in width and six (6) strips of land each six (6) feet in width lying within that portion of the Rancho Azusa, as confirmed to Henry Dalton by Patent recorded in Book 2, Page 106, of Patents, in the office of the County Recorder of said Los Angeles County, described as follows: Beginning at the Northwesterly corner of Parcel No. 8 as shown on that certain Licensed Sur- veyor's map filed in Book 29, Page 37, of Record of Surveys, in the office of said County Recorder; thence along the Westerly line of said Parcel No. 8, South 0'03'10" West 898.70 feet; thence North 89°50'50" West 924.6 feet, more or less, to the Easterly line of Subdivision No. 2, Azusa Land and Water Co., as per map recorded in Book 43, Page 94, of Miscellaneous Records, in the office of said County Recorder; thence along said Easterly line, North 0°05'35" East to the Southwesterly corner of the land described in the deed to Kirkwood E. Strip No. 1 The center line of said strip of land twelve (12) feet in width is described as follows: Beginning at a point in the Westerly line of the above described property, at said point now is located an existing Southern California Edison Company pole number 940615E, said point herein- after referred to as Point "A"; thence Easterly a distance of 210 feet, more or less, to a point in said property, at said point now is located an existing City of Azusa Light and Wafter Department pole number 4731MA, said point hereinafter referred to as Point "B"; thence Easterly a distance of 200 feet, more or less, to a point in said property, at said point now is located an existing City of Azusa Light and Water Department pole number 4730MA, said point hereinafter referred to as Point "C"; thence Northeasterly a distance of 226 feet, more or less, to a point in said EXHIBIT A Page 2 property, at said point now is located an existing City of Azusa Light and Water Department pole number 3096MA, said point hereinafter referred as Point "D". Strip No. 2 The center line of said strip of land six (6) feet in width is described as follows: Beginning at the hereinbefore mentioned Point "B"; thence Westerly a distance of 30 feet. Strip No. 3 The center line of said strip of land six (6) feet in width is described as follows: Beginning again the hereinbefore mentioned "B"; thence Easterly a distance of 30 feet. Strip No. 4 The center line of said strip of land six (6) feet in width is described as follows: Beginning at the hereinbefore mentioned Point "C"; thence Easterly a distance of 30 feet. Strip No. 5 The center line of said strip of land six (6) feet in width is described as follows: Beginning again at the hereinbefore mentioned Point "C"; thence Southwesterly a distance of 30 feet. Strip No. 6 The center line of said strip of land six (6) feet in width is described as follows: Beginning at the hereinbefore mentioned Point "D"; thence Northeasterly a distance of 30 feet. Strip No. 7 The center line of said strip of land six (6) feet in width is described as follows: Beginning again at the hereinbefore mentioned Point "D"; thence Northerly a distance of 30 feet. ALSO, a strip of land six (6) feet in width lying within a portion of Lot 84, as shown on Map of Subdivision No. 2, Azusa Land and Water Co., as per map recorded in Book 43, Page 94, of Miscellaneous Records, in the office of the County Recorder of said Los Angeles County. The center I ine of said strip of land six (6) feet in width is described as follows: Beginning at the hereinbefore mentioned Point "A"; thence Westerly a distance of 30 feet. THE GRANTEES, their successors and assigns and their respective contractors, agents and employees, shall have the right of ingress to and egress from said easement and every part thereof, at all times, for the purpose of exercising the rights herein granted and shal I have the right to trim or top trees and/or such other growth as may endanger or interfere with the use of said easement. Such rights shall be reasonably exercised and the Grantees shall be liable for any damage negligently done by said Grantees to the above described property.
