HomeMy WebLinkAboutResolution No. 6538RESOLUTION NO. 6538 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING A VARIANCE (VARIANCE CASE NO. V 495 SANMUKH BHAKTA). The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Sahmukh Bhakta (Variance Case No. V 495) request- ing permission to maintain a billboard painted on the side of a building and located within three hundred (300) feet of an existing billboard on property located at 628 North Azusa Avenue; that a hearing thereon was duly conducted by the Planning Comm- ission and the Planning Commission denied the variance; that the matter was appealed to the City Council and the City Council held a hearing thereon and proper and legal notice of hearing was duly given. SECTION 2. After due notice and public hearing, the City Council finds: (a) In the early part of 1977, without benefit of permit or variance an advertising sign was painted on the south wall of the Canyon City Hotel located at 628 North Azusa Avenue. Said sign is sixteen feet (161) wide and twelve feet (12') high and contains one hundred ninety-two square feet (192 sq. ft.) in area. Said sign advertises services other than those conducted on the premises and is therefore an outdoor advertising or bill- board structure within the definition of theAzusa Municipal Code. (b) The Azusa Municipal Code provides that no bill- board or outdoor advertising sign shall be painted on -any wall, building, or fence. The Azusa Municipal Code also provides that no billboard or outdoor advertising structure may be placed or located within three hundred feet (300') of another billboard or outdoor advertising structure. (c) The sign which is the subject of this variance application is painted on the side of a building and is located approximately two hundred seventy-five feet (275') north of an approved billboard. (d) There is no other approved billboard or outdoor advertising structure painted on a wall within the City. Permitting the sign which is the subject of this application, would be inconsistent with the objectives of the sign ordinance which is to encourage well designed and pleasing in appearance signs to encourage a desirable urban character within the City. (e) The strict application of the Zoning Ordinance will not deprive the owner of any privilege enjoyed by other property in the same vicinity and in the same zone inasmuch as there has not been allowed the establishment of any other billboard or outdoor advertising structure painted on any wall, building, or fence in the City under the current sign ordinance. (f) The granting of the variance would be materially detrimental to the public welfare and injurious to property in the vicinity by allowing the establishment of a painted sign on a building and further by allowing a billboard within less than three hundred feet (300') of an approved billboard within the City. SECTION 3. Variance Case No. V 495 is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 2Othday of June, 1977.
