HomeMy WebLinkAboutResolution No. 6512RESOLUTION NO. 6512 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE (Variance Case No. V -489 -Azusa Unified School District). The City Council of the City of Azusa does resolve as follows: SECTION 1. It is hereby found and determined that the application of Azusa Unified School District for a variance to permit a reduced lot area of 5000 square feet instead of the required 6000 square feet and reduced lot widths of 50 feet instead of the required 60 feet on that certain property located west of Azusa Avenue and south of Orkney Street was duly made, that a hearing thereon was duly held by the Planning Commission after legal notice thereof, that the Planning Commission approved said variance, subject to certain conditions, that said approval was appealed and the City Council held a hearing thereon after legal notice thereof. SECTION 2. It is hereby found by the City Council that: (a) There are exceptional circumstances applicable to the property which distinguish it from other properties in the same area in that the property is particularly suitable for development for single family residential purposes. (b) The granting of the variance will not be materially detrimental to the public welfare inasmuch as it will permit the development of the property for single family residential use which is consistent with the development of other property in the immediate vicinity. (c) The granting of a variance will not adversely affect the General Plan. SECTION 3. A variance is hereby granted as applied for in Variance Case No. V-489. It is granted upon the following conditions, the violation of any one of which shall be grounds for the revocation of this variance by the Planning Commission or the City Council and this variance shall not be effective for any purpose until the owner of the property or his duly authorized representative has filed at the office of the Planning Department his declaration stating that he is aware of and accepts all of the following conditions of this variance: 1. The minimum lot area shall be 5000 square feet with a minimum lot%width of 50 feet. 2. Wheie', garages open directly on to the street, the minimum front setback shall be 20 feet from the front property line in order to'accommodate a vehicle in the drive- way without overhanging the public right of way when the garage door is closed. A y • 3. This variance shall be effective only if the property is developed for single family residential purposes. 4. A precise plan shall be filed for review by the City Council before any building permits are issued. SECTION 4. The City Council hereby finds that the variance which is granted by this resolution will not adversely affect the environment of the area and the negative declaration of environmental impact prepared by the Planning Department and approved by the City Council has been prepared in accordance with the California Environmental Quality Act of 1970 as amended and the State Guidelines and is hereby approved. SECTION 5. The City Clerk shall certify to the adoption of this resolution. 1977.
