HomeMy WebLinkAboutResolution No. 66010 0 RESOLUTION NO. 6601 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE (VARIANCE CASE NO. V-531 ROBERT SPRAGUE) The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council does hereby find and determine that there was filed with the Plan- ning Commission the application of Robert Sprague (Variance No. V-531) requesting a variance to permit a reduced rear yard setback of 01, instead of the required 5' for an accessory building, a reduced side yard setback of 0', instead of the required 5' for a main building, and usable open area in common having a dimension of less than 15'; that a hearing thereon was duly conducted by the Planning Commission and that the Planning Commission denied the variance; that the matter was appealed to the City Council and the applicant sub- mitted a new plot plan that would only require the portion of the variance relating to the 0' rear yard setback for an accessory building, instead of the re- quired 5'; that the City Council held a hearing thereon and proper and legal notice of hearing was duly given. SECTION 2. After due notice and public hearing the City Council finds: (a) The subject property is located at 616 North Pasadena Avenue, and zoned R3a (multiple family residential). (b) The applicant is proposing to locate a detached garage building adjacent to the rear property line'and the side property. The 0' side yard setback for the accessory building is legal, however, a required rear yard setback of 5' exists. (c) A revised plot plan submitted by the applicant shows that only a reduced rear yard setback of 0' would be involved in the variance application. (d) The City Council referred the matter back to the Planning Commission for consideration of the re- vised plot plan. After consideration by the Commission it recommended that the variance for the 0' rear yard setback instead of the required 5' for an accessory build- ing be approved. Said recommendation was by unanimous vote of the Planning Commission. (e) The strict application of the zoning ordinance would deprive the owner of privileges enjoyed by other property in the same vicinity and in the same T 0 9 zone inasmuch as the location of the detached garage in the position indicated in the revised plot plan would be the most beneficial use of the property and in the best interest of all concerned. (f) The granting of the variance will have no detrimental and environmental affects. SECTION 3. Variance case number V-531 is hereby approved subject to the following conditions: 1. All construction shall comply with the revised plot plan submitted. 2. The four feet between the front of the dwelling unit and the ten foot wide driveway shall be landscaped and continuously maintained including but not limited to weeding, irrigation, and replacement as necessary. 3. Owner shall provide and maintain adequate public utility easements to replace any that might exist across the rear five feet of the subject property. 4. Owner shall bear total expense for re- location of any utilities located across the rear five feet of the subject property. 5. A six foot high decorative masonary wall shall be provided and maintained where the driveway abuts property lines. 6. The trash area shall be fully enclosed by means of the decorative masonary wall on three sides that is of adequate height to screen trash receptacles. The fourth side of said enclosure shall consist of an approved solid gate and the entire enclosure shall be adequately maintained at all times. 7. A decorative screen fence, 6' in height, behind the front building line shall be provided and adequately maintained along the north property line. The type of fence shall be subject to Planning Commission review and approval prior to construction. B. The driveway width shall be a minimum of 10' at all locations in accordance with the Azusa Municipal Code and substandard driveway approach shall be replaced with an approach complying with the Engineering Department's requirements. 9. All necessary permits shall be obtained. 10. All construction shall comply with all applicable building and fire regulations. SECTION 4. The City Clerk shall certify to the adoption of this resolution. -2- ADOPTED AND APPROVED this 5th day of December, 1977.
