HomeMy WebLinkAboutResolution No. 66640 RESOLUTION NO. 6664 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE (VARIANCE CASE NO. V 561 ROBERT STERN) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Robert Stern (Variance No. V 561) requesting a Variance to permit open carports in lieu of closed garages and a reduced setback of l' for accessory buildings along the side and rear property lines on said property instead of the required minimum setback of 5' in the applicable zone; that a hearing thereon was duly conducted by the Planning Commission and that the Planning Commission denied the Variance application; that the matter was appealed to the City Council by the applicant; that the City Council held a hearing thereon and proper legal notice of the hearing was duly given. SECTION 2. After due notice and public hearing, the City Council finds: a. The subject property is located on the west side of Calera Avenue at Hollyvale Street (south of Alosta) and is zoned R3(a) (Multiple Family Residential). b. The applicant is proposing to construct an 86 unit apartment complex and has requested that a variance be granted to allow open carports in lieu of closed garages and a reduced setback of 1' for accessory buildings (carports) along the side and rear property lines on said property in lieu of the 5' setback ordinarily required. c. The reduced setback of l' to the rear and side of the garages will be beneficial to the development in that it will reduce areas which can accumulate weeds and trash and pro- vide more usable open or landscaped area within the development. d. The Zoning Ordinance requires garages with doors for all residential developments. Reasons for requiring fully enclosed garages are: 1. Unsightliness and general unkept appearance of open carports from the driveway area; 2. Security for the vehicles housed in said garages, and 3. Security to the persons residing within the development in walking to and from the garage area. e. None of the objectives of requiring fully enclosed garages would be achieved if the City approved the requested Variance for carport. f. Strict application of the Zoning Ordinance would deprive the property owner of privileges enjoyed by other property in the same vicinity and in the same Zone as to the set- back requirement. g. The granting of the Variance as to setbacks will have no detrimental environmental effects. SECTION 3. Variance Case No. V 561 is hereby approved as to setbacks but denied as to carports subject to the following conditions: 1. The variance, as granted, is for accessory buildings onl•_ and shall not permit the encroachment of any dwelling unit or any portion thereof within the 15' rear yard setback ordinarily required by the Municipal Code. 2. All construction shall generally comply with the plot plan submitted. 3. An adequate system of utility easements shall be provided to comply with the permanent drainage provisions pro- posed in accordance with the conditions set forth in the City's approval of Parcel Map No. 3106. 4. The approval contained herein does not relieve the owner or developer of any responsibility relative to any existing installation or easement that may exist upon the property. Any relocation or rerouting of utilities or easements including, but not limited to, plans, specifications, permits, contracts, recording fees, etc., shall be at the expense of the owner. Any relocation shall be subject to review, approval, and acceptance by the individual utility company and the Director of Public Works for the City of Azusa. 5. All necessary permits shall be obtained. 6. Any and all construction shall comply with all applicable building and fire regulations. 7. This Variance is granted only as to the 1' side yard and rear yard setback for accessory buildings. 8. The Variance application for carports in lieu of garages is denied. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. 1978.
