HomeMy WebLinkAboutResolution No. 6645RESOLUTION NO. 6645 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE (VARIANCE CASE NO. V 516 NEWPORT HOMES) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Newport Homes (Variance No. V 516) request- ing a Variance to permit walls or fences over 6' high within the required side yard and rear yard setbacks adjacent to the Golf course instead of the required maximum height of 6' in residential zones; that a hearing thereon was duly conducted by the Planning Commission and that the Planning Commission approved the Variance subject to conditions; that the matter was appealed to the City Council by the Homeowner's Association; that the City Council held a hearing thereon and proper legal notice of the hearing was duly given; at the conclusion of said hearing the City Council referred back to the Planning Commission the question of the determination of the type of fence that should be approved at this location after some agreement was reached between the Homeowner's Association and the developer; that the Planning Commission has considered the type of plan agreed upon between the Homeowner's Association and the developer and has recommended approval by the Council to approve the type of fencing at the locations indicated as shown on Exhibit A attached hereto and incorporated herein by reference. SECTION 2. After due notice and public hearing, the City Council finds: A. The subject property is located at 600 West Sierra Madre Avenue and is zoned R3(b) (Multiple Family Residential). B. The applicant is proposing to install overheight fencing adjacent to the golf course and within the required side yard and rear yard setbacks of said property. C. The type size and location of the fencing pro- posed to be installed is as set forth on Exhibit A to this Resolution. D. The strict application of the zoning ordinance would deprive the property owner of privileges enjoyed by other property in the same vicinity and in the same zone in that protection is needed for the residential properties which are the subject of this application from misdirected golf balls which may impact upon said residential property. E. The granting of the variance will have no detrimental environmental effects. SECTION 3. Variance Case No. V 516 is hereby approved subject to the following conditions: 1. The fencing approved hereunder shall not exceed 20' in height, with a minimum of 7'. 2. The type, size and location of the fencing which is permitted to be installed pursuant to this variance is limited to that which is set forth on Exhibit A to this Resolution. 3. Any fence or screening approved by this Variance shall be subject to Planning Commission review no more than six months from the date of installation relative to whether additional height or screening may be required. 4. Any and all fences or screening approved under this Variance shall be properly designed by a registered engineer, all necessary permits shall be obtained for the same and all construction shall comply with all applicable codes. 5. The wrought -iron fencing as proposed on top of the existing block wall adjacent to the golf course shall have a 3' wide fire escape gate for each unit. 6. Mini -chain link screens of 15' in height shall be constructed beside the patio area of units 47 and 57 as shown on Exhibit A. 7. Patio covers as proposed shall be painted to match eaves of existing structures. 8. This Variance shall only apply to Phase I of the Meadow Greens Development by Newport Homes. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 3rd day of April, 1978.
