RESOLUTION NO. 6629
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA PROTESTING THE CHANGE PROPOSED BY
LOS ANGELES COUNTY IN THE METHOD OF DISTRIBUTION
OF FINES AND FORFEITURES.
WHEREAS, the County of Los Angeles and the Cities
of the County have operated under a reasonable interpretation
of the laws of the State relative to distribution of fines
and forfeitures for a period of many years; and
WHEREAS, the Auditor of the County of Los Angeles
has recently proposed to change the interpretation of
existing state law relative to the distribution of fines and
forfeitures between the County and Cities of the County
resulting in a reduction in the share which would be received
by the Cities and increasing the allocation of such fines
and forfeitures to the County; and
WHEREAS, such recent proposed change in interpretation
of the laws of the state by the auditor of the County of Los
Angeles would result in a substantial loss of revenue to the
Cities of the County and a grossly unfair share of such revenue
being allocated to the County.
NOW, THEREFORE, the City Council of the City of
Azusa resolves as follows:
1. That the proposed change in the distribution
of revenue from fines and forfeitures within the County is
based upon a strained construction by the county auditor of
state law governing such allocations and the City contends that
such construction is erroneous and unfair to the Cities of the
County.
2. The City of Azusa urges the League of California
Cities and all Cities to communicate their protest to the
County Auditor and the Board of Supervisors of the County of
Los Angeles and to take such legal action as may be appropriate
to prevent the unwarranted diversion of City revenues to the
County.
3. That the elected representatives of the state
legislature review existing provisions of Penal Code Section 1463
and Vehicle Code Section 40508 regarding distribution of fines
and forfeitures and take such action as may be necessary or
appropriate to clarify the law and insure that Cities continue to
receive their fair share of fines and forfeitures in accordance
with procedures which have been in effect for many years.
4. The City Clerk is directed to forward copies of
this resolution to all Cities in Los Angeles County, the League
of California Cities, the elected representatives of the State
Legislature from the County of Los Angeles and the Governor.
