HomeMy WebLinkAboutResolution No. 6703RESOLUTION NO. 6703 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING ITS INTENTION TO VACATE A CERTAIN PORTION OF PASADENA AVENUE AND FIX- ING A TIME AND PLACE FOR A HEARING THEREON. The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council of the City of Azusa, subject to the recommendation of the Planning Commission, does hereby declare its intention to vacate a portion of Pasadena Avenue between First Street and Foothill Freeway in the City of Azusa, County of Los Angeles, State of California, as shown on a map or plan on file in the office of the City Clerk to which reference is made for further particulars, bounded as follows: A portion of Pasadena Avenue as shown on the Map of Tract No. 18890, recorded in Map Book 469, Pages 28 through 32, in the Office of the Los Angeles County Recorder, and as shown on the Map of Tract No. 18318, recorded in Map Book 445, Pages 14 and 15, in the Office of the Los Angeles County Recorder, more particularly described as follows: Beginning at the northwest corner of Lot 86 as shown on the Map of Tract No. 18890, thence N 890 59' 20" E, 40.03 feet to the beginning of a tangent curve concave to the southwest, the True Point of Beginning; thence 31.42 feet along said curve through a central angle of 900 01' 10"; thence S 0° 00' 30" W, 36.36 feet to the intersection with a line being the northerly right of way line of the 210 Freeway, as it existed on the 3rd day of August, 1978; thence N 841 29' 37" E along said line 80.38 feet to the intersection with the westerly line of Lot 1 of Tract No. 18318; thence N 00 00' 30" E, 48.64 feet along said line to the intersection with the easterly prolongation of the southerly right of way line of First Street (80 feet wide) as it existed on the 3rd day of August, 1978; thence S 890 59' 20" W, 100.01 feet along said line to the True Point of Beginning. Reserving and excepting from said vacation the permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of water lines, telegraphic and telephone energy, including access and 0 - r the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon, and over the street or part thereof proposed to be vacated. The City Council does hereby determine that the public convenience and necessity require the reservation of the rights, easements and rights-of-way enumerated above. These proceedings for the vacation of said portion of Pasadena Avenue are taken subject to such reservations and exceptions. SECTION 2. The City Council of the City of Azusa does hereby elect to proceed to vacate the said portion of said street under the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. SECTION 3. The hour of 7:30 p.m. on Monday, the 2nd day of October, 1978, is hereby fixed as the time and the Council Chambers in the City Hall at 213 East Foothill Boulevard, Azusa, California, is hereby fixed as the place for hearing all persons interested in or objecting to the proposed vacation of said portion of said street. SECTION 4. Notices of street vacation shall be posted by the City Engineer in the manner prescribed by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published within fifteen days of its adoption in one regular issue of the Azusa Herald, a newspaper of general circulation, printed, published and circulated in the City of Azusa.
