HomeMy WebLinkAboutResolution No. 6858RESOLUTION NO. 6858 1J A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A ZONE VARIANCE (VARIANCE CASE NO. V630 COR VAN BEEK) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RE- SOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the Application of Cor Van Beek (Variance Case No. V630) requesting a Zone Variance to permit out- door new boat display within the required parking area and reduction in number of the off-street parking spaces required by the Azusa Municipal Code for the property located at 100 West Foothill Boulevard, Azusa, California; that a duly noticed public hearing was held on said application by the Planning Commission and that the Planning Commission denied the said Zone Variance Application; that the matter was appealed to the City Council by the applicant and a duly noticed public hearing was held by the City Council on said appeal; during the hearing before the City Council new evidence in the form of a proposed reduction in the number of off-street park- ing spaces to be occupied by outdoor display of new boats was submitted to the City Council; the City Council determined that the case should be reconsidered by the Planning Commission based upon the changed evidence and referred the matter back to the Planning Commission for that purpose; the matter was reviewed by the Planning Commission in light of the modified application and the Planning Commission recommended to the City Council that the Zone Variance be approved subject to certain conditions. SECTION 2. After due notice and public hearing the City Council finds: A. The subject property is located at 100 West Foothill Boulevard, Azusa and is zoned C3 (General Commercial). B. The applicant in his revised application is requesting a variance to permit new boat display within five parking spaces and the access thereto located on the northeast corner of the subject property. C. The area of the application is designated central business district by the general plan. D. The subject property is presently developed with a 9,470 sq. ft. building and parking area for 22 vehicles. A retail structure of this size requires a minimum of 38 off-street parking spaces, however, in 1977 a prior variance was granted to allow the reduced off- street parking. The granting of that variance was by Planning Commission Resolution No. 1379. E. The type of business conducted at this location involves a large display area for the purpose of displaying several boats. As a result, the anticipated occupant load per square foot of building is less than the occupant load per square foot for a business such as a grocery store. Both the subject business and a grocery store 0 are, however, treated the same in terms of off-street parking requirements by the Municipal Code. F. An assessment of environmental impact has been prepared which indicates that the proposed variance as revised should have no detrimental environmental effects. SECTION 3. Zone Variance Case No. V630 is hereby approved subject to the following conditions: 1. The outdoor display of boats as approved herein shall be restricted to the five parking spaces and access thereto located on the northeast corner of the subject property (at the intersection of Azusa Avenue and Foothill Boulevard) and in no case shall there be more than ten boats on outdoor display at any one time. 2. The variance as approved herein shall be for the outdoor display of new boats on trailers only. 3. This variance shall expire two years from the date of approval or at the time the use of the subject property changes from new boat sales or there is a change of ownership or management, whichever of said conditions first occurs. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. 1979.
