A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A ZONE VARIANCE
(VARIANCE CASE NO. V656 ARLEENE G.
CARDENAS)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find
and determine that there was filed with the Planning
Commission the application of Arleene Cardenas
(Variance Case No. V656) requesting a zone variance to
allow a single car garage instead of the required two
car garage, a reduced rear yard setback of 17'5" instead
of the required 25' and a reduced side yard setback of
20" instead of the required 5'; that a duly noticed public
hearing was held on said application by the Planning
Commission and that the Planning Commission denied the
said zone variance application; that the matter was appealed
to the City Council by the applicant and a duly noticed public
hearing was held by the City Council on said appeal.
SECTION 2. After due notice and public hearing
the City Council finds:
A. The subject property is located at 103
South Lemon Avenue, Azusa and is zoned R -lc (Single
Family Residential).
B. The subject property is presently developed
with a single family residence and an attached single car
garage. The surrounding property is also developed with
single family residences and those that have garages have
a mixture of one and two car garages.
C. The area of the application is designated
medium density residential (up to fifteen dwelling units
per acre) by the general plan.
D. The subject property was originally developed
with a single family residence and a single car garage in
1948. In 1951 a building permit was issued for a 120 sq.ft.
addition to the garage. In 1955 a permit was issued for a
600 sq.ft. garage. In 1956 a permit was issued for the
construction of a bedroom, 3/4 bath, and service porch between
the garage and the residence.
E. Subsequent to the issuance of the permits noted
above, a structure has been added to the rear of the garage
and a portion of the garage has been converted to residential
use.
F. In order to obtain building permits for the
addition which was actually constructed, applicant is
requesting a zone variance to allow the reduced garage
requirement and the reduced side and rear yard setbacks.
SECTION 3. The Zone Variance Case No. V656 is
hereby approved subject to the following conditions:
1. All construction shall comply with the plot
plan submitted.
2. All necessary permits shall be obtained.
3. All building department and fire department
requirements shall be met.
4. The proposed addition if used as a guest house
must comply at all times with Section 19.04.330 of the
Azusa Municipal Code and the appropriate provisions of the
Building Code relative to room sizes, ceiling heights, etc.
5. Non-compliance with or violation of any of
the conditions set forth herein shall be grounds for
revocation of any approvals contained herein. Any such
revocation shall be in accordance with the provisions of
Section 19.60.160 of the Azusa Municipal Code.
SECTION 4. The City Clerk shall certify to the
adoption of this Resolution.
ADOPTED AND APPROVED this 3rd day of March ,
I hereby certify that the foregoing Resolution
was duly adopted by the City Council of Azusa, at a
regular meeting thereof held on the 3rd day of March
1980, by the following vote of the Council:
