The City Council of the City of Azusa met in regular session at the above time and place. Present at roll call: Councilmen: McIntire, Carr, Arnold, Chester, City Roll call. Attorney and City Clerk. Absent: Mayor Morden. Councilman Chester suggested that the Council appoint a new chairman as he ' thought the chair should not be con- tinuously occupied by one Councilman, but that each member of the Council serve as Mayor or Mayor Pro tem during their term of office. Councilman Arnold nominated Councilman Carr. Councilman Carr declined the nomination. Moved by Councilman Chester, seconded by Councilman Arnold Councilman Carr that Councilman Arnold to serve as Mayor serve as Mayor Pro tem in the'absence of Pro tem. Mayor Morden. Carried by the following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester. Noes: None. Absent: Mayor Morden. Councilman Arnold not voting. Thereupon Councilman Arnold took the chair. ' Roll call: Councilmen: McIntire, Carr, Roll call. Chester, Arnold, City Attorney and City Clerk. Absent: Councilman Morden. The minutes of the last regular meeting Minutes approved. of June 1, 1936 were read and approved as read. A communication from the State Compensation Insurance Fund, one from the Pacific Rock Communications filed. & Gravel Company, an invitation from the City of Pasadena and a communication from Thomas Maloney were read. Moved by Councilman Chester, seconded by Councilman McIntire that same be placed on file. - Carried by the following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester, Arnold. Noes: None. Absent: Mayor Morden. Mr. J. C. Muehe offered a bid on Liability ' Insurance for the Swimming pool. Moved by Councilman Carr, seconded by Councilman Chester that same be referred to Councilman McIntire to'report back at the next regular meeting of the Council. Carried by the following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester, Arnold. Noes: None. Absent: Mayor"Morden. A report from the Azusa City Planning Commission signed by Cornelius Smith, denying the request of Mr. Sehio to operate a wine store at #305 Azusa Avenue, was read. J. C. Muehe's bid on Liability Insurance referred to Council- man McIntire. Report of the Azusa City Planning Commiss- ion ordered placed on file. 50HGU MINUTES OF THE CITY COUNCIL MEETING. A communication from Mr. Smith, relative to the condition of the streets in Tract 8507 was read and ordered placed on file. Councilman Chester offered a Resolution entitled: ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ADOPTING BUDGET SET FORTH IN PROJECT STATEMENT SUBMITTED TO THE DIRECTOR OF PUBLIC WORKS OF THE STATE OF CALIFORNIA FOR EXPENDITURE OF ONE-FOURTH CENT GAS TAX ON STREETS OF MAJOR IMPORT- ANCE WITHIN THE CITY OF AZUSA. Moved by Councilman Chester, seconded by Councilman Carr that this Resolution be adopted as read and numbered Resolution No. 1495. Carried by the following vote of the Council: Termites in City Hall Building referred to Jack Pierce. City Clerk report on C. H. Burnett's request for a refund. Communication from the Attorney representing the Assets,Reconstruct- ion Corporation re- ferred to the City Attorney. Communication from Mr. Smith ordered placed on file. RESOLUTION NO. 1495 ADO PT ED. Moved by Councilman McIntire, seconded by Councilman Carr that same be placed on file. Carried by the'following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester, Arnold. Noes: None. Absent: Mayor Morden. A report on the condition of the City Hall Building, relative to termites, was offered by Abbatt's Termite Control. Moved by Councilman Chester, seconded by ' Councilman McIntire that same be referred to Jack Pierce for recommendation. Carried by the following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester, Arnold. Noes: None. Absent: Mayor Morden. The City Clerk reported on the matter of C. H. Burnett's request for refund of taxes on property occupied by the Southern Counties Gas Company. Moved by Councilman Carr, seconded by Councilman Chester that the City Clerk be instructed and authorized to draw a check on the General Fund in the amount of $99.12 in favor of C. H. Burnett, in pay- ment of refund of taxes. Carried by the following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester, Arnold. ' Noes: None. Absent: Mayor Morden. A communication from the Attorney re- presenting the Assets Reconstruction Corporation, Ltd. relative to the agree- ment regarding water supply to Tract 8507 was read. Moved by Councilman Chester, seconded by Councilman McIntire that same be re- ferred to the City Attorney to check agreement and to report back at the next regular meeting of the Council. Councilman Chester offered an Ordinance entitled: AN ORDINANCE OF THE CITY OF AZUSA, IAS ANGELES COUNTY, CALIFORNIA, ESTABLISHING A PLAN FOR REDEMPTION OF REAL PROPERTY SOLD TO THE CITY OF AZUSA FOR DELINQUENT TAX AND/OR ASSESSMENT, IN CONFORMITY WITH ' THE PLAN UNDER STATE LAW FOR REDEMPTION OF REAL PROPERTY SOLD FOR DELINQUENT COUNTY OR STATE TAX AND/OR ASSESSMENT. to be placed upon its first reading. This Ordinance was then read for the first time. Councilman McIntire offered an Ordinance entitled: AN ORDINANCE OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, PROHIBITING THE DRINKING OF INTOXICATING LIQUOR UPON OR IN PUBLIC STREETS, ALLEYS, SIDEWALKS, PARKS, PARKWAYS OR OTHER PUBLIC WAYS OF SAID CITY. to be placed upon its first reading. This Ordinance was then read for the first time. Moved by Councilman Chester, seconded by Councilman McIntire and duly carried that same be accepted and placed on file. Mr. Smith, who requested the Council to abandon a portion of a street south of the Santa Fe Right of Way, withdrew his re- quest and agreed to replace the fence on his own property line. ' Pat Pollard, the Life Guard at the Swim- ming pool was instructed by the Mayor Pro tem and members of the City Council on the manner in which they expect him to super- vise the public who patronize the pool. Councilman Carr requested the passage of an Ordinance protecting the police officers when a prisoner resists arrest. Moved by Councilman Chester, seconded by Councilman Carr and duly carried that same be referred to the City Attorney to re- port back at the next regular meeting. 421 7:30 P. M. Ordinance read for the first time. City Attorney reported on the iron grating. Same referred to Councilman Chester. City Attorney offered the proposed Los Angeles County Sanitation and Health Code. Mr. Smith withdrew request to abandon street. Lifeguard given in- structions. Ordinance protecting Police Officers re- ferred to the City Attorney. City Attorney Miller reported on the iron grating or bars built across the window,in the Auditorium�marked "Exit". ' Moved by Councilman McIntire, seconded by Councilman Carr that same be referred to Councilman Chester with power to act. Carried by the following vote of the Council: Ayes: Councilmen: McIntire, Carr, Chester, Arnold. Noes: None. Absent: Mayor Morden. City Attorney Miller offered the revised ordinance to be adopted by Los Angeles County, called the proposed Sanitation, Health and Food Code. Moved by Councilman Chester, seconded by Councilman McIntire and duly carried that same be accepted and placed on file.
