RESOLUTION NO. 6927
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA APPROVING A CONDITIONAL
USE PERMIT (CONDITIONAL USE PERMIT CASE
NO. C234 LOUIS FARINO)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find
and determine that there was filed with the Planning
Commission the Application of Louis Farino (Conditional
Use Permit Case No. C234) requesting a Conditional Use
Permit to allow a condominium development (new construc-
tion) within an R -3b Zone on property located at
737 South Donna Beth Avenue; that a duly noticed public
hearing was held on said Application by the Planning
Commission and that the Planning Commission denied the
said Conditional Use Permit; that the matter was appealed
to the City Council by the Applicant and a duly noticed
public hearing was held by the City Council on said appeal.
SECTION 2. After due notice and public hearing
the City Council finds:
A. The subject property is located at
737 South Donna Beth Avenue, Azusa and is zoned R -3b
(Multiple Family Residential).
B. The Applicant is seeking to establish a
condominium development by new construction of a 20 -unit
condominium on vacant land.
C. The property to the north and south is
developed with multiple family residential developments
(conventional apartments). The property to the west
is zoned C-2 and although developed with an older residential
structure is being used for a commercial use. The property
to the east (across Donna Beth Avenue) is zoned for and
developed with single family residential uses.
D. The general plan designates this area as
high density residential (up to 28 dwelling units per acre).
E. The proposed development complies with
standards set forth in Planning Commission Resolution No.
873 as to minimum floor area, density, distance between
buildings, ground coverage, storage, and laundry and utility
area.
F. As to resident parking, the plans submitted
indicate one garage and one open space as resident parking
for each dwelling unit. Although the garages are located
within 150 feet walking distance of each unit, the open space
for unit number one of each building exceeds the 150 feet
walking distance. As to guest parking, the plans submitted
indicate five open guest parking spaces which appear to be in
excess of the 150 feet walking distance from unit number one
in each building.

G. As to usable open area, the plans submitted
indicate a total usable open space of 11,445 feet including
600 square feet of pool area. The total usable open area
indicated is 555 square feet short of the 12,000 square feet
usable open area required. It does appear that the
location of the usable open area as indicated meets the
intent of the requirement for at least half of the usable
open area to be immediately adjacent to the unit it serves.
H. The trash area indicated in the plans is
approximately 70 square feet and a minimum of 103 square
feet will be required.
I. With regard to traffic and circulation, the
property is proposed to be served by one 25 -foot wide drive-
way from Donna Beth Avenue. Parking will be absolutely
prohibited in any of the drive and access areas and
approval from the Fire Department will be required at the
time of consideration of the precise plan.
SECTION 3. Based upon the evidence submitted
in the case, Conditional Use Permit Case No. C-234 is
hereby granted subject to the following conditions:
1. The Development shall comply with Planning
Commission Resolution No. 873 except that minimum lot size
approved hereunder shall be .98 acres.
2. The Development as proposed shall comply with
the appropriate sections of the Azusa Municipal Code.
3. A subdivision map shall be prepared in
accordance with the State Subdivision Map Act and the
City of Azusa Engineering Department requirements and
properly processed and recorded. Any and all conditions
of the approval of such a Subdivision Map are made a part
hereof and shall be met at all times.
4. A decorative masonry wall six feet in height
shall be provided and maintained at all times on all
perimeter property lines except those that are abutted by
structures exceeding six feet in height immediately adjacent
to the property line on the surrounding abutting property.
The only exception to this shall be that said wall shall not
exceed 42" in height within any required front yard setback.
Chain link fencing adjacent to driveway and parking areas
is unacceptable.
5. Full compliance with all conditions set forth
by the Planning Commission upon review of the final plans
under the precise plan review are made a part hereof and shall
be met at all times.
6. Electronic garage door openers shall be provided
and maintained for each unit.
7. Recreational vehicle parking is absolutely
prohibited unless an approved screened from view both on
and off the property recreational vehicle storage area is
provided. Any such recreational vehicle storage area cannot

include any required off-street parking spaces, and must be
in addition to any required off-street parking spaces and
access thereto required for a development of this nature.
Said parking cannot include any required usable open area.
SECTION 4. The City Clerk shall certify to the
adoption of this Resolution.

at a regular meeting thereof held on the 21st day of July
1980, by the following vote of the Council:
