HomeMy WebLinkAboutResolution No. 6980RESOLUTION NO. 6980 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING A ZONE VARIANCE (VARIANCE CASE NO. V699 JESUS T. RODRIGUEZ) THE CITY COUNCIL OF THE CITY OF ASUZA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Jesus T. Rodriguez (Variance Case No. V699) requesting a zone variance to waive the two car garage re- quirement for a single family dwelling on the property located at 117 North Dalton Avenue; that a duly noticed public hearing was held on said application by the Planning Commission and that the Planning Commission denied the said zone variance application; that the matter was appealed to the City Council by the applicant and a duly noticed public hearing was held by the City Council on said appeal. SECTION 2. After due notice and public hearing the City Council finds: A. The subject property is located at 117 North Dalton Avenue, Azusa and is zoned FS (freeway service). B. The subject property is presently developed with a single family residence. The surrounding area is similarly developed. C. The area of the subject property is designated high density residential (up to 28 dwelling units per acre) by the general plan. D. Building permit files do not include permits for the original development of the subject property. By appearance the dwelling was probably constructed sometime prior to the mid 1950's.. E. Prior to June 6, 1957 the Azusa Municipal Code required that two off street parking spaces be provided for a single family residence. Since that date the Municipal Code requires that every single family residence have a two car garage and further requires that this condition be met any time floor area or roof area is added. F. Applicant is currently proposing an addition to the rear of the residence without providing the two car garage required by the current zoning ordinance. The variance request seeks a waiver of the two car garage requirement. The reasons stated for the request are financial. G. There is adequate space on the property to com- ply with the garage requirement including adequate space for an 8111" driveway along the south side of the property. 0 0 H. The strict application of the provisions of the zoning ordinance would not result in practical difficulties or unnecessary hardships inconsistent with the general purpose and intent of the ordinance. I. There are no exceptional circumstances or con- ditions applicable to the property involved or to the intended use or development of the property that do not apply generally to other property in the same zone or neighborhood. J. The granting of this variance would be materially detrimental to the public welfare or injurious to the property or improvements in the zone or neighborhood in which the sub- ject property is located. K. The granting of this variance would be contrary to the objectives of the Master Plan adopted by the Commission. SECTION 3. Based upon the foregoing findings the Zone Variance case No. V699 is hereby denied. SECTION 4. The City Clerk shall certify to the adop- tion of this Resolution. 1981 .
