HomeMy WebLinkAboutResolution No. 6979RESOLUTION NO. 6979 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING A ZONE VARIANCE (VARIANCE CASE NO. V693 BRUCE STEINBAUM) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: Section 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Bruce Steinbaum (Variance Case No. 693) requesting a zone variance to permit garages without the required doors or the elimination of the required garage parking spaces on the property located at 805 South Cerritos Avenue; that a duly noticed public hearing was held on said application by the Planning Commission and that the Planning Commission denied the said zone variance application; that the matter was appealed to the City Council by the appli- cant and a duly noticed public hearing was held by the City Council on said appeal. SECTION 2. After due notice and public hearing the City Council finds: A. The subject property is located at 805 South Cerritos Avenue and is presently improved with an 88 unit apart- ment development and the required 132 parking spaces. The subject property is presently zoned R3A (multiple family residential) B. The property to the north and west of the subject property is developed with a single family residential develop- ment. The property to the south (across Big Dalton Wash) is developed or is being developed with multiple family residen- tial family uses. The property to the east on the north side of the Wash is developed with single family residential uses and on the south side of the Wash is developed with commercial uses. C. The area of the subject property is designated high density residential (up to 28 dwelling units per acre). by the general plan. D. The subject property currently has the required number of enclosed parking spaces as provided for by the Code. The applicant is seeking authority to remove the garage doors thereby making the parking areas unenclosed based upon the claim that the cost of maintenance of the doors is excessive. Appli- cant also contends that there would be an aesthetic benefit to removal of the garage doors. E. Fully enclosed garages if adequately maintained provide security for vehicles stored in them by screening the vehicles from public view. F. If adequately maintained the fully enclosed garage structures provide a more aesthetically pleasing sight than an open front garage area or a completely open parking area. G. Adequately maintained fully enclosed garage struc- tures with doors provide additional security to residents be- tween the garages and their dwelling units. H. The reason. for the requirement of fully enclosed garagesis the same today as when the requirement was established by ordinance. I. The strict application of the provisions of the zoning ordinance would not result in practical difficulties or unnecessary hardships inconsistent with the general purpose and intent of the ordinance. J. There are no exceptional circumstances or condi- tions applicable to the property involved or to the intended use or development of the property that do not apply generally to other property in the same zone or neighborhood. K. The granting of such variance would be materially detrimental to the public welfare or injurious to the property or improvements in this zone or neighborhood in which the sub- ject property is located. L. The granting of such variance would be contrary to the objectives of the Master Plan. SECTION 3. Based upon the foregoing findings Zone Variance Case No. V693 is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. 1981.
