A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A ZONE VARIANCE
(VARIANCE CASE NO. V692 LUCIO D. CRUZ)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find
and determine that there was filed with the Planning
Commission the application of Lucio D. Cruz (Variance
Case No. 692) requesting a zone variance to permit an
overheight fence of 6' instead of the permitted height
of 3'6" within the required front yard setback on the
property located at 389 East Sierra Madre Avenue; that
a duly noticed public hearing was held on said application
by the Planning Commission and that the Planning
Commission denied the said zone variance application;
that the matter was appealed to the City Council by the
applicant and a duly noticed public hearing was held by
the City Council on said appeal; during said appeal
hearing new evidence was introduced into the proceeding
resulting in the matter being referred back to the
Planning Commission for consideration of the new evidence
and report; after the Planning Commission considered the
new evidence it recommended approval of the variance
subject to the imposition of certain conditions.
SECTION 2. After due notice and public hearing
the City Council finds:
A. The subject property is located at 389 East
Sierra Madre Avenue, Azusa.and is zoned RA (residential
agriculture).
B. The subject property is presently developed
with a single family residence. The property to the
north and west is developed with single family residences,
the property to the east is presently being used for the
storage of plants in containers. A portion of the property
to the south (across Sierra Madre Avenue) is developed with
a park and the remainder is also used for the storage of
plants in containers.
C. The area of the application is designated
low density residential (up to six dwelling units per acre)
by the general plan.
D. The applicant is proposing a 6' high masonry
wall across the front of the property with wrought iron gates
at the driveway. The property to the west is developed with
a similar fence which is, however, along a side property line.
SECTION 3. The Zone Variance Case No. V692 is
hereby approved subject to the following conditions:

1. All construction shall comply with the plot
plan submitted.
2. All necessary permits shall be obtained.
3. All construction shall comply with applicable
building department and fire department requirements.
4. The Variance as approved herein does not
authorize any overheight walls within the area set forth
by Section 11.65.010(b) of the Azusa Municipal Code.
5. Adequate drainage facilities or structures
be provided to the satisfaction of the Director of Public
Works.
6. All used building materials, debris, and trash
shall be removed from the property and it shall be landscaped,
maintained in a satisfactory manner.
7. Noncompliance with or violation of any of the
conditions set forth herein shall be grounds for revocation
of any approvals contained herein. Any such revocation shall
be in accordance with the provisions of Section 19.60.160 of
the Azusa Municipal Code.
SECTION 4. The City Clerk shall certify to the
adoption of this Resolution.

I hereby certify that the foregoing Resolution
was duly adopted by the City Council of Azusa, at a
regular meeting thereof held on the 2nd day of March
1981, by the following vote of the Council:
