HomeMy WebLinkAboutResolution No. 7172RESOLUTION NO. 7172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDINGS OF TELEPHONE AND RADIO COMMUNICATIONS MAINTAINED BY THE POLICE DEPARTMENT. THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Pursuant to the provisions of Section 34090.6 California Government Code, the Chief of Police is hereby authorized to destroy recordings of telephone and radio communications maintained by the Police Department after 100 days of the recording of such communications. Except that where such recordings are evidence in any claim filed or any pending litigation such recording shall be preserved until pending litigation is resolved. SECTION 2. This authorization to the Chief of Police to destroy recordings of telephone and radio communications more than 100 days old shall be a continuing authorization to destroy all such recordings,subject to the litigation exception, when the same have been retained for at least 100 days. SECTION 3. This Resolution shall become effective upon the written approval endorsed hereon by the City Attorney. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. 1982.
