RESOLUTION No. 7169
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A ZONE VARIANCE
(VARIANCE CASE NO. V751.SALVADOR MADRIGAL)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find
and determine that there was filed with the Planning
Commission the application of Salvador Madrigal
(Variance Case No. V751) requesting a zone variance to
,allow'the distance between buildings of 3' instead of
the required 6'; to allow rear yard coverage of 65%
instead of the permitted 35%; and to reduce the setback
to 6" instead of the required 5'; that a duly noticed
public hearing was held on said application by the
Planning Commission and that the Planning Commission denied
the said zone variance application; that the matter was
appealed to the City Council by the applicant and a duly
noticed public hearing was held by the City Council on
said appeal.
SECTION 2. After due notice and public hearing
the City Council finds:
A. The subject property is located at 623
Vernon Avenue, Azusa and is zoned R -lc (Single
Family Residential).
B. The subject property is presently developed
with a single family dwelling anda single -car garage.
The surrounding property is also developed with single
family residences and those that have garages have a
mixture of one and two car garages.
C. The area of the application is designated
low density residential by the general plan.
D. Subsequent to the issuance of the permits
noted above, a structure has•been added to the rear of
the garage and a portion of the garage has been converted
to residential use.
E. In order to obtain building permits for the
addition which was actually constructed, applicant is
requesting a zone variance to allow the reduced garage
requirement and the reduced side and rear yard setbacks.
SECTION 3. The Zone Variance Case No. V751 is
hereby approved subject to the following conditions:
1. All construction shall comply with the plot
plan submitted.
2. All necessary permits shall be obtained.
3. All building'department and fire department
requirements shall be met.
4. The proposed addition if used as a guest house
must comply at all times with Section 19.04.330 of the
Azusa Municipal Code.
5. The northerly structure is to be used for
garage purposes only -- said, structure may not be utilized
for dwelling purposes.

6. The southerly structure is to be utilized
as a guest house -- said structure may not contain kitchen
facilities as defined by the zoning code.
7. The plan check is to be required as well as
processing of a precise plan.
8. The structures must be brought into compliance
with the building code and other health and safety provisions
of the code.
9. Non-compliance or future deviations or
violation of any of the conditions set forth herein shall be
grounds for revocation of any approvals contained herein and
will necessitate the demolition of the subject structure.
Any such revocation shall be in accordance with the provisions
of Section 19.60.160 of the Azusa Municipal Code.
SECTION 4. The City Clerk shall certify to the
adoption of this Resolution.
